Provided, howovor, that if a widow or widower in whom
such interest shall havo voBtcd as nforosuid, sliull thoronftcr
marry again and doconso leaving a widower or widow nnd n
child or children of such first mnrriago surviving, tho interest of
the docoased shall vost in such child or children. And further
provided, that in ease two or more persons suceood togothor to
the intorcsts of any Occupier or Lossoo, according to tho fore
going provisions, thoy shall hold tho sarao by joint tonanoy so
long ns two or moro shall survivo, but upon tho death of the
last survivor, tho ostato shall doscond according to tho pro
visions of tho first part of this soction. And in case of such
joint tenancy tho continuous rosidenco of any such tonants
upon tho promieos shall bo sufliciont performance of tho con
ditions of rosidonco sot forth in Sootions 33 and 39.
Suction 41. In-case of tho death of an Occupier or Lossoo
the intorost of tho successors 'shall not bo liable to fortoituro
during a period of six months from such doath. If no suc
cessors to tho docoased tenant tako possession of tho promises
within n year from tho death of such tonant, tho premises shall
thereupon vost in tho Government.
Section 45. In case two or moro persons succeed togoth
or to tho intorost of an Occupier or Losseo, any ono or moro of
such persons less than tho wholo numbor may filo in tho office
of the Sub-Agent an offer to tho remainder of such persons to
buy their interest in the premises or to soil to thom thoir own
interest therein at a stated prico according to tho proportion of
tho respective intorost in question, and may deposit with tho
Sub-Agont tho amount of such ofl'orod prico in money, with a
fco of ton dollars. Tho Sub-Agont shall thereupon notify tho
parties to whom such ofler is mado of tho naturo of the offer and
order thom to filo with him thoir answor within sixty days
wbethor they will buy or soil according to such offor. If the
partios to whom suoh offor is mado filo with tho Sub-Agont
within sixty days of tho timo of thoir rocoiving suoh notifica
tion of thoir answor stating that thoy will sell thoir intcrost ac
cording to tho terms of the offor, tho Sub-Agont shall ondorso
tho fact of suoh salo with tho amount of tho consideration on
tho certificate of occupation or tho leaso as tho caso may be,
and pay to suoh parties tho amount of such consideration de
posited with him according to thoir individual intcrost; and tho
intorost of such parties shall thoroupon vost in tho parties mak
ing tlio said offer. Tho fact of suoh transfor shall bo properly
recordod in tho official (records of tho Sub-Agont and ondorsod
upon tho certificate of occupation or lenso hold by thoOooupior
or Lessoc. If, howovor, tho partios to whom buoIi offer is mado
fail to answer within sixty days from tho timo of thoir boing
notifiod of suoh offer or within sixty days from tho timo tho
notioo of suoh offer is mailed to their last known place or
places of abodo or shall answor within sixty days that they will
buy tho interest of tho parties making suoh offor on tho torms
o fibred, but fail within sixty days aftor suoh notification to de
posit tho amount roprosonting tho valuo of such intoroBt ac
cording to tho terms ofi'erod, their interest shall vest in tho
parties making tho offor and the amount of suoh consideration
shall bo paid by tho Sub-Agent to thom individually or their
respcotivo representatives upon application. In suoh caso the
fact of such transfor shall bo recordod and endorsed as nbovo
But if the parties to whom such offor is mado snail, within
sixty days from tho timo of such notification, mako answor to
tho Sub-Agont that thoy will buy tho intorost of the offering
parties, and shall deposit within sixty days with him tho
amount required fur suoh purposo according to tho terms of tho
ofler, tho Sub-Agont shall ondorso nnd record tho fact of such
salo as above provided, and pay to tho offering partios tho said
umount, according to thoir individual interest; and tho intorost
of tho offering parties shall thereupon vost in tho answormg
partios. In suoh caso tho consideration money deposited by the
offering partios shall be returned to thom.
Section 40. Tho limit of .sixty days abovo providod in
which partios shall answer, shall dato from tho timo the last per
son entitled to notification is notifiod, in tho manner abovo set
forth. No transfor of intorost in a certificate of occupation or a
loaso ownod by two or moro porsons as provided in Soction 45
shall bo valid if uny of tho said porsons aro minors under tho
