In tho Circuit Court this morn
ing, with both nativo unci foreign
juries in rUtondnnco, when tho

several cases in which the attor
neys interested put in no appear
ance. Business mon on tho jury
wero highly gratified to hear
Judge Carter quietly remark that
in all such cases hereafter ho
would bo prepared to hear a mo
tion to dismiss the notion by tho
opposing party on the spot. There
aro sumo dilatory attoruoys who
think that courts should await
their pleasure before trying a caso,
but Judgo Carter is evidently of a
different opinion.
Tho Supremo Court by Justico
Frear, with whom by stipulation
only the Chief Justico sat, has
rendered a decision in A. 1 Gon
salveo vs. Pnlriho. It revorses tho
judgment of tho District Court of
South Kona, Hawaii, which was
beyond his jurisdiction in order
ing specific performance of a con
tract, and in that it was rendered
for both parties, and in that it
cannot bo enforced by any pro
cess that tho District Magis
trate can issuo. Tho caso
is
remanded to tho Dis-
trict Court of Soath Kona for
new trial. Croighton efc Correa
for plaintiff; Thurston it Stanley
for defendant.
Mrs. lluth Horn petitions for
probate of tho will of her late
husband, J. C. F. Horn, in which
she is named as devisee, legateo
and executrix. There is personal
property of about S3500 and no
real estate. Tho will is a holo
graph ono executed in presence
of Robert W. McOhesnoy and
Jesso M. McChosuey on April 2G,
1889, when tho testator was sixty
three years old.
Judge Carter adjudged libels
for divorce on Saturday as fol

H. Focko and Cecil Brown,
trustees of tho estate of James
Gay, have rendered their annual
account. Receipts SG895.04, pay
ments SGG25.11, balance $209.93.
The stock on tho ranch consists of
441 head cattle, 5 mules, G mares
and 3 stallions. Horses woro sold
realizing $1852.88 during tho year.
Cattlo increased by 111 head, none
having been sold.
In the suit of Jas. J. Byren vs.
John Allen and others, B. F, Dil
lingham answers for himself and
the Oahu Railway and Land Com
pany, to tho effect that A. Feek,
ono of the defendants, was pro
mised seven bouds of $101)0 each
par value, bearing 5 por cent, in
terest, to bo delivered after com
pletion of tho l ail way from Waia
nao to Kaoua Point, and that if
the road should not bo extended
the value of Peek's interest in tho
railway would not bo worth ono
cent.

that the sugar interest of the isl
ands is opposed to annexation.
"At least a goodly minority of tho
plantors," ho says, "clearly seo tho
necessity for annexation as the
only way to guarauteo political
and honco cominorcial stability."
Ho also says that a protectorate is
not desired, because of its un
certainty. Mr. Castlo is in a good position
to spouk by tho card, as ho is him
splf largoly interested in planta
tion stock. Besidos this ho knows
tho islands well. But his admis
sion that tho majority of tho
planters aro against annexation is,
as ho will doubtless concede, of
much more importanco in its re
lation to tho Hawaiian future than
his assertion that tho minority are
in favor of it. Tho majority de
termine tho extent and forco of
sugar iniluenco on legislation;
they mold foreign public opinion
upon tho issuos that concern them;
they Bpoak in the mandatory way
for their whole class. Few listen
to tho minority. They do not
make themselves particularly folt.
Honco tho forco of tho statement
that "tho planters aro against an
nexation" is not greatly impaired
by the admitted fact that somo of
thorn are not. It is like the caso
of tho Democratic party, which is
nono tho loss against econonfto
protection becauBO of the as
surance that a fow of its members
aro in favor of it.
So long as a majority of tho
sugar mon stand whero thoy do
tho cause of political union be
tweon tho islands and the United
States is in obvious jeopardy.
Wo can think of no hotter politics
for tho annexationists, therefore,
than to do somo wholesome mis
sionary work among that class
while waiting for conditions to
