How the Porto Rico
Bill Was Passed
Washington, Feb. 23. Tlio Inst day

o'clock with nearly cveiy member In
his sent and n veiy large nudlcnco In
the galleries. '1 ho lendcis on both
sides were nctlvcly engaged In rallying
their forces and making computations
upon the flnnl vote, which Is to bo tak
en under tlio order at 3 o'clock. Mr.
Underwood of Alabama, the Demo
cratic whip, said tho result would bo
very close and would turn upon tho
vote of two or thrco men on tho Demo
cratic side. Mr. Tawncy, the Repub
lican whip, saiu tho bill would have
live votes to spare. Ho said the main
danger lay In tho motion to recommit.
Immediately after tho reading of tho
Journal, the clerk began reading tho
bill for amendment, under the flvc
mlnuto rule.
When Section 3 was reached Mr.
Payne, chairman of tho Ways and
Means Committee, offered tho follow
ing substitute:
"Section .1 That on and after the
passago of this act all merchandise
coming Into tho United Statr from
Porto Rico and coming Into Porto Rico
from tho United States shall ho entered
at the several ports of cutty upon the
payment of 1C per cent of tho duties
which were required to bo levied, col
lected and paid upon like articles of
merchandise Imported from foreign
countries nnd in addition thereto, upon
nrtlclcs of merchandise of Porto ltlcnn
manufneturo coming Into the United
States and withdrawn for consump
tion or sale, upon payment of a tax
equal to tho internal revenuo tax Im
posed In tho United States upon tho
like nrtlclcs of merchandise of domes
tic manufacture; such tax to bo paid
by Internal rovenuo stamps to bo pur
chased nnd provided by tho Commis
sioner of Internal Revenue, nnd to bo
procured from the Collector of Internal
Revenue at, or most convenient to,
tho port of entry of said merchandise
In the United States, and to be aftTud
under such regulations as the Com
missioner of Internal Revenue, with
tho approval of tho Secretary of the
Treasury, shall prescribe; and on all
articles of merchandise of UntteJ

provided In payment of a tax equal In
rate and nmount to tho Internal reve
nue tax Imposed In Porto Rico upon

ture." Mr. Payne explained that tho substi
tute did two things It reduced tho
duty from 25 to 1G per cent, and It
nlso removed somo confusion regard
ing double taxation. Mr. Payne paid
he still adhered to tho opinion that
25 per cent would ho better than If.
per cent, becauso It would ralso more
revenue, but 15 per cent was b'St'.er
than nothing. In answer to a question
as to how much ino bill, as nmended,
would raise, Mr. Pnyno said tho esti
mate for tho original hill was ?1,700,
000. If that estimate was correct, tho
nmended bill would raise nbout $1,250,
000 per annum.
Mr. Pnyno took occasion to reprovo
somo of his critics who had complain
ed that he had given no explanation nf
his change- of front. His speech and
his rcpoit, he said, gavo a full expla
nation. He had believed In frco trado
with Porto Rico nt ono tlmo, but hub
sequent Information had convinced
him that the duty proposed by 'ho
pending bill should be Imposed.
Mr. Berry of Kentucky said tho
amendment proposed potty Instead of
grand larceny for tho pcoplo of Porto
Rico. Ho ridiculed the laborious de
bate through which the House had
passed over tho question of what tho
"United States" meant under tho Con
stitution. If tnls country had been
called "Columbia" Instead of "Tho
United States," 1200 pages of the Con
gressional Rccoid could have been
eliminated. No ono would have had
tho hardihood to contend then that tho
Constitution dm not extend over
cveiy foot of soil.
Mr. nyno offered tho additional soti
tion ngrecd on by tho Republicans
Monday night, as follows:
"This act shall bo taken and held to
bo provisional In Its purpose nr.u In
tended to meet n pressing present need
for rovenuo for tho Island of Porto
Rico, nnd shall not continue in force
after March 1, l'Ju."
Mr. Powers of Vermont, Sibley of
Pennsylvania, Tompkins of New York
and Hepburn of Iown'spoko In behalf
of tho bill.
Tho bill was opposed In shuit
speeches by Mr. Do Almond of MIs
soml, Mr. Fitzgerald of Massachusetts
and Mr. Otcy of Virginia, nnd wns
defended by Mr. Glow of Pennsylvania,
Graff of Illinois, Mr. Bromwoll of
Ohio, who had hitherto opposed tho
mensuro, nnd Mr. Grosvcnor of Ohio.
Tho Pnyno nmendment was adopted
without division,
Mr. Payne offered a preamble to tho
bill reciting the serious condition of
affairs in tho Island, and It was adopt
ed on a rising voto of 1C3 yeas to 131
nays.

tho House Into a furoro of oxcttemeut.
Ho described how he believed It to
bo tho duty of every man In a great
crisis to rlso nbovo party and support
tho Government as ho did during tho
Spanish wnr.
"I believe -now wo should follow tho
lead of tho President," said ho em
phatically, "and I will vote for this
bill "
This statement electrified the House,
Tho Republicans, without waiting for
him to finish his sentence rose en
mnsso and cheered, whllo tho Demo
crats sat stunned and dazed. Mr,
Cummlngs stood with arm upraised
until the Republican npplauso ceased,
"I will vote for this bill," ho con
tinued, addressing tho Republican

It was now tho turn of tho Demo
crats to cheer, and for several minutes

chusetts, on behalf of tho minority,
orfcicd ns a substitute tho bill for frco
trado with Porto Rico, originally In
troduced by Mr. Pnyno, nnd tho yens
and nays woro ordered.
