A unanimous decision of the .Supremo Court constituted by Chief Justloo Krear, Justice Oalbralth and J. A. IJolte nt night without lawful excuse. Tho opinion of the Court Is by Jus tice Qalbrnlth. It sustains the excep tions nnd orders a new trial. The syl labus of tho opinion reads thus: ' 'Without lawful excuse,' In section 370, Penal U.WB, 1897, means without lawful authority or a reasonable ba llet In lawful authority. 'One who goes upon tho premises of nnother, by night, for n lawful purpose, nnd, on the Invitation of one right fully occupying the premises, without tho consent of tho owner, remains over night. Is not there 'without lawful ex cuse.' The Incident on which defendant wis accused occurred during plaguo quar antine, when a Hoard of Health regula tion forbude anyone changing nbo.ie without permission of tho health au thorities. The trial Judge charged the Jury that defendant violated the law If ho was uway, from his abode at the time without permission. Tho Supreme Court says, "That part of tho Instruc tions relative to the regulation of 'ho Hoard of Health does not seem to bo pertinent to any Issue. In the case nnl we think It should havo been omitted." Tho exceptions sustained were to the charge of the Circuit Judge to the Jury, ' nnd to the Judge's order overruling mo-! tlon for a new trial.
