Now York, March 30. A special to
tho Herald from Washington says: If
Emcllo Agiilnaldo has violated any of
tho laws of war and declines to take
tho oath of allegiance to the United
States he will be tried by a military
commission to be appointed by Major
General MasArthur. This Is tho Im
portant feature of tho Instructions sent
by Secretary Root to General MacAr
thur today regarding the disposition to
bo made of tho prisoner
General MacArthur will mako no
bargain with Agiilnaldo, giving him
freedom In return for his aid In estab
lishing tho recognition of American
sovereignty. He will Inform Agiilnaldo
that tho Government Is disposed to
deal leniently with him, and he will
be held for tho present as a prisoner of
war. Ho will be kept under close
surveillance, ho as not to be ablo to
communicate with his former subor
dinates to the Injury of tho United
States. Ho will be allowed, if ho de
sires, to take tho oath of allegiance and
then to acquaint tho Filipinos gen
erally with what ho has done and his
views as to their future course.
Agiilnaldo has not placed himself In
a position to bo offeied any terms by
tho United States under any of the
proclamations or Instructions govern
ing tho Philippines. No attempt will
bo mado to bargain with him and he
will first hnvo to accept the sovereignty
of tho United States and also show that
ho comes within tho terms of tho am
nesty offered before he could even bo
offered n position under tho Govern
ment, If It seemed doslr.iblo to uso him
In a governmental capacity In the fil'
turo. At present Agiilnaldo will bo
considered on tho samo footing with
tho other prisoners.
Tho position of tho United States In
referenco to tho prisoner seems to liar
been misunderstood In some, quarters,
and thcro was nu Impression that our
officers wcro ready to mako terms with
Agiilnaldo In order to secure his ser
vices for the pacification of the Islands.
It Is ovldent that any overtures to
bring nbout this result will havo como
from Agiilnaldo. No noubt ho will bo
given an oppoituulty to mnko a propo
sition of that kind, but until ho docs
