DOPE FIEND IN THE COURT
Says McAuliffe Promised to Ride

racy Case.
When Wra. Cunningham took the
stand in the conspiracy case In the Po
lice Court yesterday afternoon, he con
tradicted ei erjtlilng that Leepcr, the
principal witness tor the srosecitlon,
had said about his connection with the
alleged crooked work at tho track.
Mr. Cunningham told his story directly
and without hesitancy, answering with
satisfaction the questions put to him
by the prosecution.
Tho summary of the evidence ad
duced during the afternoon Is as fol
lows: James McAuliffe: "I am a jockey.
Was In Australia ten years. Trained
horses for Prince David hero. Had a
conversation with Cunningham at the
track. Ho asked me how the horse
Weller was, and I answered that he
was nil right. He said he thought Mc
Closkcy would win. He mentioned n
ob and said ho did not think I was
going to ride the horse. I spoke to
Prince David about It. On Monday be
fore tho races Lcepcr returned from
dinner between S:30 and 6:30. Ho
came straight to mo and told me ot
what was doing. I told Mr. David."
Prof. Shorey said, In part: "On the
morning of June 12th I received a cap
sule from Colburn. I examined It and
found that It contained 277 grains of a
drug known ns alius. On a human be
ing a dose of allrs will take effect In
twelve hours."
Dr. J. I. Shaw: "Am acquainted
with the action of alius. It Is used as
a purgative. It takes from eighteen to
twenty-one hours for a drug of the
kind to work on a horse. To purge a
horse, tt would take 480 grains."
F. J. Colburn: "I received the cap
sule from Prince David the evening of
June 10, at the boat house of Mrs. Rets.
It was In perfect condition when I re
ceived itM
Prince David was recalled to answer
a question as to the program published
In the papers. This having been done,
the prosecution rested.
Hobert Carlisle: "I didn't see Crni'
nlngham In the Favorite saloon on the
evening of Juno 10 and I was there
from 0 to 11:30 p. m. If ho had opened
his desk, I would have seen him." (It
will bo remembered that Leeper swore
ho saw Cunningham at his desk when
he went Into the saloon on tho night
mentioned.)
Wra. Cunningham: "I don't know
anything at all about the rbargo
against me. I never paw Mr. I.ecper on
the night of June 10. I was not at tho
Favorite saloon at all. In tho after
noon I was out nt tho track. Camo In
to town nnd went to the Mint saloon.
Got some money, went homo'hnd had
dinner. After dinner rame to town
and met Frank Pacheco between tho
Favorite saloon and tho water trough
near by. We both drovo to the pool
room. After that, went to tbe Mint sa
loon and talked race propositions until
11 o'clock. Got a hack at Hotel and
Richards street and went home, t
didn't give Morgan a capsule to glvo to
I.ccpcr. I didn't give him 1200 to glvo
to Leeper. After the races were over.
I heard more or less talk that I had
fixed McAuliffe. I went out and told
McAullffo all I had heard at the pool
rooms and said It was all Col burn's
fault. McAuliffe said he was going to
give the Prince a good, square ride.
After this talk nbout tho rumors In
town, the track men said that Lcepcr
was a dope flend on Mm Coast."
Harry MrfVray testified to seeing
Cunningham and Pacheco at tho pool
rooms between 8 and 9 o'clock.
Tho bet witness on tho stand was
J, Brown, the plumber. His evidence
was unimportant.
At 4:30 o'clock tho court adjourned
setting tbe case for 10 o'clock today.
