SIDEWALKS AND OTHER PUB
LIC PLACES IN THE CITY AND
COUNTY OF HONOLULU.
lie it ordained by the People cf
the City and 'County of Honolulu:
Section 1. No person or persons,
flriu or corporation shall, in nny
manner br for nny purpoBC, bleak
up, 1Ik up, disturb, nuclei mine, or
dig under, or causn to he broken up,
dug up, dlstuibcd, undermined, or
dug under, nny public highway,
tticet, thoroughfare, alley or side
walk, or any other public placo In
the City and County of Honolulu,
without having flrxt obtained n writ
ten permit therefor from tho City
and County Clerk.
Section 2. Any person, firm or
corporation doslilng n permit to
break up, dig up, disturb, under
mine or dig under nny public high
way, street, thoroughfare, alley or
sidewalk, or other public place In
thu City and County of Honolulu
shall make application therefor, des
ignating tho character and location
of such excavation or breaking up,
(o tho City and County Engineer or
Road Supervisor or Road Overseer of
the appropriate illstilct. Tho City
uml County Engineer or lloail Su
pervisor or Road Overseer shall
forthwith file such application with
thu City and County Clerk, with tho
lecomniemlntion of such Engineer or
Hoard Supervisor or Road Overseer
an to tho time for which such per
mit shall be granted, and the amount
of thu bond, If any such bond shall
lie runulred as hereinafter piovldod.
Thu City anil County Clerk shall

upon the filing of thu required bond

permit, limited In time us so recom
mended, to break up, dig up, dis
turb, undermine, or dig under, thu
public highway, street, thorough
fare, ulley or sldewallt, or other pub
lic place as designated In such ap
plication, A fccpnruto permit shall
bu rcqulicd for each placo to bo cx
cauted or disturbed, und for each
300 feet In length or fraction there
of of any continuous excavation or
disturbance of any bucIi place. If
nny person or persons, firm or cor
poiatlou desires such permit for tho
purpose, of laying underground
wiles for any telegraph, telephone
or slguul system, the application for
such penult shall be made diicct to
tho Hoard of Supervisors, and ns a
condition to the granting of such
penult the Board of Supervisors may
requlie such puison or persons, mm
or corporation to furnish to tho City
und County of Honolulu, and place
in position, conduit facilities for tho
laying uuderground by the City and
County of Honolulu ot wires for
any police and fire alarm system or
signal s) stem for use by tho City
und County ot Honolulu.
Section 3. It shall bo the duty or
the City and County Engineer, and
of tho respective Road Supervisor or
Road Overseers to overseo and In
spect nil excavations nmt other dls
tui bailees fur which a penult has
been granted, and beforo any such
penult shall be issued by the City
and County Cleric, tho applicant
therefor shall pny to tho City und
County Clerk to cover the cost of
such Inspection and the Issuance of
such permit, a permit fee of the sum
of fifty cents. All permit fees col
lected by the City und County Clorls
under this Ordinance shall bo turned
over to tho City and County Treas
urer at tho end of each and evory
Section 4. The person or persons,

City and County of Honolulu, nnd
the officers and agents thereor, from
nil claims, demands, suits, actions or
proceedings of eveiy name, charac
ter und description which may bo
biought against said City and Coun
ty of Honolulu, or any odlcer .or
agent thereor, for or on account of
any injuries or damages to any per
son or persons, or property, received
or sustained by any person or per
sons, firm or (oiporatlon, by or In
consequence of any net or ads of tho
person to whom such penult Is Is
sued, or lite agents or sc(viiii(h In or
about the woik catered by such per
mit, or by or on account of nny nccl
dent In connection therewith, or by
or on nccount of any violation of nny
of the provisions of this Ordinance
by the person to whom such permit
Is Issued, or by his agents or ser
vants, nnd to pay to the City and
County of Honolulu nny penalty re
covered against the person to whom
such permit 11 Issued or his agents
or servants for nny violation of the
provisions of this Ordinance and nny
expense which may have been In
clined by the City nnd County of
Honolulu by reason of nny violation

agents or servants. Sureties on such
bonds shall severally qualify before
the City nnd County Clerk In the
amount of the penal sum specified

Section 7. Thu City and County
Clerk shall keep on lllo nil recom
mendations issued by the City nnd
County Engineer or Road Supervisor
or Road Overseer under this Ordin
ance, nnd shall keep a duplicate ot
all permits Issued by him hereunder.
Section 8. Any pel son or persons,
firm or corporation, who shall vio
late nny ot the provisions of this
Ordinance, shall bu deemed guilty of
a misdemeanor, and upon conviction
thereof shall be punished by lino not'
exceeding $S.'0.U0, und not let, than
Ju.00, or by imprisonment not ex
ceeding three months, or both.
Section 9. This Ordlnanco shall
tako effect and be In force from and
after the dato ot Its npproval.
