Wilkins To Withhold NAACP Alabama Names "At Whatever Cost" Lawyers Prepare Further Legal Action to Stay SIOO,OOO Fine NEW YORK Undaunted by the Alabama Supreme Court’* rejection of an application to stay execution of the SIOO,OOO con tempt of court fine levied against the Association by Circuit Court Judge Walter B. Jones for fail ure to produce its memberrship list, attorneys for the National As sociation for the Advancement of Colored People prepared this weekend further legal action to avert payment of the fine. As a first stop, Robert L. Car ter, NAACP assistant special counsel, said, the lawyers will re turn to the Alabama Supreme Court with a petition for a wrtt of certiorari asking for a review of the lower court’s ruling against the association. Meanwhile, he asserted, the attorneys are ex ploring other legal avenues to se cure a stay of the execution of the SIOO,OOO judgement The decision to withold the name of the 14,566 NAACP members in the state of Alabama followed a telephone poll of the association’s national board of directors. By a margin of three to one, the directors who could be reached indicated to executive secretary Roy Wilkins that he should decline to submit the names to the Alabama court for the inspection of the state’s at torney general. In a staement issued following imposition of the fine on July 30, Mr. Wilkins charged that the sum demanded was ‘punitive, even confiscatory. Obviously, this amount is beyond our ability to pay out of regular income,** he said. “We intend to use every possible legal step to contest this excessive fine.” Citing the persecution to which NAACP members and other ad vocates of desegregation have been subjected in Alabama “both by public officials and private groups and individuals,” the NAACP leader said that “to turn the list of our members over to Alabama authorities under such circumstances would be to be tray their trust and confidence in us. Burdell, president of the Coop er Union, to provide facilities to maintain the tuition-free college’s leadership in engineer ing and art education. Grand Jury Indicts Reputed Policy King ST. LOUIS—(ANP) —A well known St. Louis gambler was indicted last week by a circuit court grand jury after police de scribed him as one of the key figures in the policy racket here. Robert Harris Jr., who owns a fleet of taxis was accused of es tablishing a lottery following his arrest in a June 22 policy raid when police saw him throw a package on top of a garage as officers followed him.
