Montgomery Boycott Action
Lies in Hands of High Court
MONTGOMERY (ANP) —'
As the effective and crippling Ne
gro bus iboycott here enters into
its 11th month, no action by
either the boycott leaders or the
city commission or ♦ v - u ” v ’-
pany is expected until the U. S.
Supreme Court act*
from a special panel of three
Federal judges.
The judges ruled last June that
city and state segregation laws in
transportation were unconsftitu
tutional. The action was brought
by several Montgomery Negroes
after the boycott reaches a stale
mate.
The three-judge ruling was ap
pe;led to the Supreme Court by
attorneys for Alabama.
Three city commissioner*, in
cluding the Mayor of Montgomery
joined White Citizens Councils
shortly after the boycott began.
All of the officials are staunch and
outspoken proponents of segrega
tion in all phases of life.
The boycott began Dec. 5 after
the arrest dbid conviction of Mrs.
Rosa Parks for refusing to give
up her seat and move to the rear
of the bus to make room for
whites.
The Montgomery Improvement
Association wgs then formed by
Negroes who elected the Rev.
Martin Luther King as president.
The boycott began that same day
and has continued ever since.
TRIAL SET IN
S. C. TEACHERS’
CASE
CHARLESTON, S. C. A trial
set for Oct. 22 here will be con
cerned with the case of more than
20 Negro teachers who were dis
charged from their teaching po
sitions because they refused to
sign a new anti-NAACP member
ship oath required by the state.
Attorneys for the NAACP will
ai’gue the teachers’ case before
a three-judge federal court. The
lawyers are expected to base their
case on denial of the constitu
tional rights of freedom of
speech and freedom of association
and to ask that the teachers not
be excluded from their school po
sitions because of refusal to sign
the oath. «
The plaintiffs all taught in Ell
oree, S. C. The anti-NAACP oath
/was inserted in teacher employ
ment applications for the 1956-57
school year, after the 1956 Gen
eral Assembly enacted legislation
bcrring NAACP 'members from
state, county and municipal em
ployment. May 31, 1956, was the
deadline for signing the new oath.
Alabama Negroes to

mingham drop its racial barriers
and hire Negro patrolmen, a suit
filed Lst week by two Negroes

to gain employment as police
men asked $25,000 damages for
failure of the city to let them take
police examinations.
