SAN FRANCISCO. Aug. 18. Three Alameda County
Superior Court judges in a split decision ruled unconstitution
al California's Proposition Three, which exempted non-profit,
private elementary and high schools from property tax.
Confusion created by the
statement issued by Hi- Eminance
James Francis Cardinal McIntyre.
Archbishop of Los Angeles, who
pointed out that the ruling applies
merely to Alameda County alone
and not to the rest of the State.
It has been announced that the
decision will be appealed to the
California Supreme Court by the
District Attorney of Alameda
County.
In rendering their 2-to-1 deci
sion. the three judges declined to
hand down a written opinion.
Californians went to the polls
last November 4 and voted in fa
vor of Proposition Three, which
brought California in line with
the other 47 States of the nation
in recognizing the contribution of
private schools to the welfare of
the community by exempting
them from property taxes.
The suit in the Alameda County
Superior Court was instituted by
Alfred J. Lundberg, chairman of
the California Taxpayers’ Alliance.
It asked that the provisions of
Proposition Three be declared null
and void because they violated the
State Constitution as well as the
First Amendment of the U.S. Con
stitution.
LOS ANGELES (NC) In a
statement issued here on the Ala
meda County CoTirt ruling on
Proposition Three, Cardinal Mc
Intyre declared:
"The decision of the Superior
Court of Alameda County is con
fusing. Confusing and upsetting,
first, because it affects Alameda
County alone and not the remaind
er of the State second, because it
upsets the scales of justice as pro
vided by the vote of the sovereign
people of California.
It is also confusing because it
was a split decision of three iudg
es. Usually the law' in these cir
cumstances requires a unanimous

men are solidly behind the Code.

California Court Voids Referendum Exempting Private Schools from Taxes

The issue was clearly understood
by the people. Almost a half mil
lion voters, with knowledge and
forethought, registered their opin
ion upon the question which was
intelligently and completely sub
mitted. A split decision, rendered
without a written opinion in Ala
meda County, now attempts to void
the will of the people and the
legislature in whom the power of
legislation resides and this on an
apparent questioned technicality.
“Confusion is further present be
cause schools for those of college
level are exempted. The action of
the legislature and the people in
the recent referendum was to cor
rect this injustice and give to the
elementary and secondary schools
the same exemption and to make
them share equally with higher
education.
“But this effort to equalize and
correct the prolonged injustice
against the less favored is now
looked upon as unconstitutional by
the court ot Alameda County. Con
tradiction as well as discrimination
seems apparent at leant to the
practical mind. This decision as
rendered affects only the non-prol
it schools in Alameda County. It
affects those which are conducted
hy the Protestant groups, by the
Catholic groups or by private indi
viduals, but only in Alameda Coun
ty.”

Dr. Vasconcelos’ action came
shortly after Bishop Gerard de
Proenca Sigaud of Jacarezinho had
issued a statement warning that
spiritualism, or spiritism, was
speading “like a plague over all
Brazil.”
(Spiritualism is a practice where

cate with the souls of the dead or
other spirits. It involves supersti
tion and Catholics are forbidden to
take part in it.)

Dr. Vasconcelos declared that “to
divide spiritually the nation is anti
patriotic.” He branded spiritism
as “denying and opposing funda
mental dogmas of the Catholic re

total circulation of 19,765,809
for 572 Catholic newspapers and
magazines in the two countries.
The total newspaper circulation
is listed as 3,788, 947 and the
magazine figure is 15.976,862.
Thus, magazines alone now sur
pass in circulation the 15,830,
684 figure given in last year’s
directory for the entire Cath
olic press.
