Ky. (NC) Attorneys on both sides nave agreed to a “statement of facts” in the suit against the uns in public schools in Kentucky. It will be presented to the Franklin County Circuit Court where the case is to be tried. This move was made in order to obviate lengthy testimony in arriving at the facts of the case and to permit the court to render a decision without undue delay. The suit was filed last October 13 by the Rev. J. C. Rawlings, a retired Methodist minister and president of the Kentucky Free Public Schools Committee, an af filiate of the POAU. Defendants in the case are Wen dell P. Butler, state superintendent of public instruction, and the school boards of six Kentucky counties in which altogether 84 nuns are employed as public school teachers. The 72-year-old envoy. Dr. Wolfgang Jaenicke, is a Protes tant and his appointment followed a long and sometimes bitter dispute as to whether a Protestant or a Catholic should be named as Germany's first post-war ambassa dor to the Holy See. One side in sisted that Germany was “tradi tionally” represented by a Protest ant at the Holy See. The other side held that there was no such ■tradition and that a Catholic was better fitted for such a post.
