(NC) The state attorney general and his deputy have said here that no "reasonable" argument" can be made that the “public wel fare demands the education of children of any particular faith in sectarian schools." The statement was in a brief filed before the Vermont Su preme Court which is hearing a controversial case on the issue of tuition payments from state funds to non-public high schools. The test case was initiated by the South Burlington School Board. This town was the hard est hit of 96 towns by a decision of the state board of education that it could no longer appropri ate funds to be used by local schools boards for tuition pay ments to non-public schools. Attorneys for South Burling ton have argued in court that the tuition payments are public welfare benefits and therefore consitutional. It was this conten tion that the attorney general singled out in his counter-argu ment. In the final brief to be filed in court, Atty. Gen. Robert T. Staf ford and his deputy, Frederick M. Reed, said that all Vermont children are guaranteed an edu cation by Vermont law. But, the two asked: “Are they deprived of an education, as such, if tuition is not paid at a parochial school?” “The answer is absolutely no, because it must be paid at pub lic schools. They may not receive an education which their faith requires, but they will receive the education which the law re quires." o----------------- Reporter’s Play Debuts on Kraft TV Theater NEW YORK (NC) Bob Crean, former staff writer for the N.C. The state high court’s ruling also calls for the surrender of the girl to Mrs. Doherty. Chief Justice Stanley E. Qua of the high court, who gave the decision, said: "The in ference is irresistible thet the appellants (the Ellises) have spirited the child away to evade the decree of the Pro bate Court. It is plain that the appellants cannot have their appeals heard here while they persist in flouting the decrees of the court." The Ellises secured custody of the child shortly after birth in 1951.
