The object of this Bill of
Complaint is to obtain a decree
that Plaintiffs have absolute
ownership and the right of dis
position of a parcel of land as
described in a deed dated Jan
uary 21, 1885 from Benjamin F.
Thomas, et al, unlo Lavinia F.
Hood and Sarah J. Thomas, and
recorded among the Land Rec
ords of Montgomery County in
Liber EBP 34, Folio 339, more
particularly described as fol
lows:
All that lot of land in Mont
gomery County, Maryland of
which the said Richard
Thomas died possessed being
part of a tract deeded by Ig
natius Waters to the said
Richard Thomas, recorded
February 4, 1851 in Liber STS
5 at folio 508 being part of
Pigmans Inheritance, de
scribed as follows:
Beginning at a stone
marked IWMC planted at or
near the end of 39 perches on
the first line of Pigmans Inher
itance and running thence

The Bill states in substance
that Plaintiffs own said land as i
the surviving heirs at law of
Thomas Walter Pugh, who died
November 19, 1954, leaving a
Last Will and Testament di
recting that said land be sold
and the proceeds divided equally
among the aforesaid heirs and
others; that said Will has been
admitted to probate and the
Plaintiffs, Thomas R. Pugh and
Willis T. Pugh named executors
of said estate, as will appear by
reference to 10351 Administra
tions in the Orphans Court of
Montgomery County; that
Thomas Walter Pugh obtained
title to the above described land
by deed from J. Forest Walker
Treasurer of Montgomery Coun
ty, dated November 4, 1930 and
recorded among the Land Rec
ords aforesaid in Liber 510 st
folio 248; that said land was
assessed to the said Lavinia F.
Hood and Sarah J. Thomas and
was sold unto the said Thomas
Walter Pugh for non-payment
of State and County taxes as
will appear by reference io
Item 99 in 1034 Miscellaneous
Petitions in the Circuit Court
for Montgomery County; that
the deed to Lavinia F. Hood and
Sarah J. Thomas, as recorded in
Liber EBP 34, folio 339, consti
tutes a hostile, outstanding
claim affecting the title of the
Plaintiffs; that it is not known
whether the said I-avinia F.

whether they left surviving
them heirs, devisees or personal
representatives or whether they
or their heirs, devisees or per
