That the Petition is a citi- . zen of the United States and a resident of Montgomery Coun- ] ty, Maryland, and that he has j been so resident for more than one year preceding the filing of the Bill of Complaint. ' . 2. That the Defendant is a nonresident of the State of Maryland, whose last known 1 address is Tucson, Arizona. 3. That the Petitioner and De fendant are husband and wife, having been married in Rock ville, Maryland, by a Minister of the Gospel on October 29, 1945. 4. That one child was born as a result of said marriage, namely, Kathleen Ann Gibbs of the age of 14 years, who is presently in the custody of the Plaintiff. 5. That the parties hereto vol untarily agreed to live separate and apart and by agreement have lived separate and apart since December 14, 1950, and j have not cohabited as husband! and wife since that time, which ! Is more than three years from ■ the date of filing Bill of Corr plaint. 6. That the separation of the parties has continued uninter-! ruptedly since December 14, j 1950, and is deliberate and final, j and the separation of the par ties is beyond any reasonable expectation of a reconciliation. The Bill then prays that the; Petitioner be divorced a vinculo! matrimonii from the Defend ant, and the Petitioner may be awarded guardianship and cus tody of Kathleen Ann Gibbs, the minor child of said mar riage, and for such other and further relief as his case may require. It is thereupon this 26th day of January, A.D., 1961, by the Circuit Court for Montgomery County, Maryland, sitting as a Court of Equity, ordered that the Petitioner, Richard G.
