Next Monday is the expira
tion date of the notary public
commission sought by Torcaso.
He was appointed by Governor
Tawes in 1939, but when he re
fused to declare his belief in
God the commission was with
held by Clayton K. Watkins,
clerk of the Montgomery Coun
ty Circuit Court.
Many observers see the case
as a challenge to the Maryland
Constitution. It could also fur
ther define the rights of atheists
under religious freedom guar
antees in the federal constitu
tion.

granting the application.
She pointed out both the
Montgomery County Planning
Board and its technical staff
recommended approval on the
ground that it would be a log
ical extension of commercial
zoning at the District line.
“This application,” she said,
‘‘would not adversely affect the
neighborhood any more than

ping center.”
While conceding that “we
don’t zone for a particular
store or other structure,” Mrs.
Wemer emphasized that the
ownership of the entire tract by
one firm makes good usage
much more likely.
