two and one-half baths, recrea
tion room and carport.
TERMS OF SALE
A cash deposit of $1,000.00
will be required at the time of
sale. The balance in cash, with
interest at six per centum per
annum from the date of sale to
the date of payment, payable
within two days after final rati
fication of sale.
Adjustments on all taxes, pub
lic charges and special or regu
lar assessment will be made as
of the date of sale and there
after be assumed by the pur
chaser. Title examination, con
veyancing, State and Federal
revenue stamps, transfer tax,
and all other costs incident to
settlement are to be paid by the
purchaser.
Compliance with terms of sale
shall be made within two days
after final ratification of sale or
deposit shall be forfeited and
the property resold at the risk
and cost of the defaultant pur
chaser. The property will be
sold subject to a prior encum
brance, the terms and condi
tions of which will be an
nounced at the time of sale,
with a balance of approximately
$22,327.51.

The object of this bill is to
obtain a decree declaring that
the plaintiffs, Gilbert C. Carr
and Nettie F. Carr have abso
lute ownership and the right of
disposition of a tract containing
14 acres more or less; and also
declaring that the plaintiff,
Gilbert C. Carr, has absolute
ownership and the right of dis
position of a tract containing 44
square perches, also of the
adjacent tract containing 3.192
acres, all of said tracts situate
in the Fifth Election District of
Montgomery County, Maryland;
and to enjoin all persons named
as parties defendant from as- 1
serting any claim to any of said
lands by any action at law or
otherwise.
The bill states in substance:
that by deed recorded in Liber
No. 1051, folio 464, plaintiff
Gilbert C. Carr obtained title to
a parcel containing 44 square
perches, sold at tax sale April
14, 1930, assessed in the name
of the defendant George Grisby,
but described in said deed as
George Grisley; said land being
further described in deed from
Charles Proctor and wife to
George Grisby, recorded in Liber |
No. 278, folio 376; that plaintiff |
Gilbert C. Carr, for more than
twenty years has been in actual |
and peaceable possession of an
adjacent parcel containing 3.192 [
acres, described in paragraph 6
of the bill, the record title to
which appears to be in the de
fendant, Charles Proctor, as the
sole heir-at-law of Frederick
Proctor, said lands being the
same as described in a deed
from Charles Stabler and wife,
to Frederick Proctor, recorded
in Liber E.B.P. No. 2 folio 336;
that the plaintiff Gilbert C.
Carr has been in actual and
peaceable possession of said two
parcels of land for more than
twenty years.
That the plaintiffs Gilbert C.
Carr and Nettie F. Carr obtain
ed title to a tract containing 14
acres more or less, by deed
dated April 26, 1935 and record
ed In Liber 592, folio 121, being
land sold at tax sale April 10,
1933, assessed in the name of
“Mary C. Carr and Sisters,”
being the defendants, Mary C.
Carr, Martha Carter, Cassandra
Mitchell, Elenora Miles and Cas
sandra Queen; said parcel being
part of a tract originally con
taining 16 acres described in a
deed from Charles Stabler and
wife to Thomas Mitchell, record
ed in Liber E.B.P. No. 9, folio
416, excepting therefrom 4’ 2
acres described in a deed to
Albert G. Mitchell, recorded in
Liber E.B.P. No. 9, folio 417;
also excepting the parcel of 44
square perches, described in
deed recorded in Liber No. 278,
folio 376; all deed references
being to the Land Records of
Montgomery County.
That the plaintiffs have no
knowledge of whether said de
fendants, George Grisby, Mary
C. Carr, Martha Carter, Cas
sandra Mitchell, Elenora Miles,
and Cassandra Queen are resi
dents or non-residents of the
State of Maryland, or whether
they or any of them be living or
dead, and if dead, whether any
of them left a Last Will and
Testament which has been duly
probated, nor, if any of them
died testate or intestate; wheth
er any of them left any heirs
at-law or next of kin; or wheth
er there be any successor in
interest of any of them; where
fore, suit is brought against the
defendants, George Grisby,
Mary C. Carr, Martha Carter,
Cassandra Mitchell, Elenora
Miles and Cassandra Queen, if
living, and if they or any of
them be dead, the successors in
interest of any such person, not
known to be living or dead, and
described as the unknown heir,
' devisee or personal representa
tive of such person; that the de
fendant Charles Proctor is a
■ non-resident, residing in Wash
■ ington, D. C.
It is thereupon this 22nd day
