CHAPTER 9
(BILL NO. 17)
AN ACT authorizing the issu
ance of bonds of Montgomery
County, Maryland, in a princi
pal amount not exceeding SIOO,-
000 upon its full faith and cred
it, to provide for expenditures
not exceeding SIOO,OOO for fin
ancing improvements to the
Montgomery County Airpark at
Gaithersburg, Maryland, pre
scribing the terms and condi
tions, by reference, upon which
said bonds shall be issued and
delivered, and other incidental
details with respect thereto, and
providing for the application of
the proceeds of such bonds on
terms and conditions to be pre
scribed by the County Council,
declaring that the immediate ex
pansion and Improvement of ex
isting airport facilities In Mont
gomery County Is a public pur.
pose and necessary to the wel
fare of the inhabitants of Mont
gomery County and providing
for the levy of unlimited ad
valorem taxes for the payment
of the principal and interest of
such bonds.
BE IT ENACTED BY THE
COUNTY COUNCIL FOR
MONTGOMERY COUNTY,
MARYLAND,
that—
Sec. 1. Montgomery County,
Maryland is hereby authorized
at any time and from time to
time, upon its faith and credit
to borrow money and incur in
debtedness in a total amount not
exceeding SIOO,OOO for financing
the construction, reconstruction,
extension, acquisition, enlarge
ment, alteration, repair and
modernization of the airport fa
cility known as Montgomery
County Airpark, with respect
but not limited to the buildings,
hangars, pavements, runways,
taxiways and parking areas of
said airport.
Sec. 2. Section 2-107 through
Section 2-115, inclusive of the
Montgomery County Code 1960,
as amended, and each and every
part of such sections, excepting
therefrom only subsections (a)
and (b) of Section 2-107, be and
they are hereby incorporated in
this Act, by reference, as a part
hereof, it being the intention of
the County Council that said
sections shall be applicable in
all respects to the borrowing of
money, the issuance of bonds,
the application of the proceeds
of such bonds, and the levy of
unlimited ad valorem taxes for
the payment of the principal
and interest of the bonds au
thorized by this Act.
Sec. 3. Before borrowing any
money or issuing any bonds
pursuant to the authority, the
County Council shall adopt, in
addition to or as a part of any
other resolutions required by
Sections 2-107 through 2-115 of j
the Montgomery County Code |
1960, a resolution prescribing
the terms and conditions on
which the proceeds of the bonds
authorized hereunder shall be :
made available for the purposes J
designated in this Act.
Sec. 4. It is hereby determined
and declared that the public in- j
terest of the citizens of Mont
gomery County requires the im-1
mediate expansion and improve
ment of existing airport facili
ties in Montgomery County. The i
issuance and sale of bonds for
the purposes authorized in this
Act are hereby determined and
declared to be for a public pur
pose and the welfare of the in
habitants of Montgomery Coun
ty.
Sec. 5. The powers granted by
this Act are additional and cu
mulative and the bonds author,
ized by this Act may be issued
notwithstanding that other bond
acts or laws may provide for
the issuance of other bonds or
the borrowing of money for the
same or similar purposes on the
same or other terms and condi
tions.
Sec. 6. This Act shall take ef
fect August 15, 1963.

CHAPTER 8
(BILL NO. 7)
AN ACT to add a new sub
section (e) to Section 2-34 of
the Montgomery County Code
1960, authorizing the establish
ment of a budget division in the
department of finance.
BE IT ENACTED BY THE
COUNTY COUNCIL FOR
MONTGOMERY COUNTY,
MARYLAND,
that—
Sec. 1. A subsection (e) to
Section 2-34, titled “Powers and j
duties of director”, is hereby |
added to Article IV, titled "De- j
partment of Finance”, Chapter j
2, titled" Administration”, Mont
gomery County Code 1960, to
follow immediately after sub
section (d) of Section 2-34, to
read as follows:
“(e) To establish a budget di
vision within the department to
assist in the preparation, pres
entation and administration of
the annual county budget and to
perform such other related

Sec. 2. This Act shall take
effect August 15, 1963.

CHAPTER 1
(BILL NO. 1)
AN ACT to repeal and re
enact, with amendments. Sec
tion 36-2, Chapter 36, title “Hy
attstown”, of the Montgomery
County Code 1960, to increase
the maximum authorized tax
rate from five cents to ten cents
on each one hundred dollars of
assessable real and personal
property.
BE IT ENACTED BY THE
COUNTY COUNCIL FOR
MONTGOMERY C OUN TY,
MARYLAND,
that—
Sec. 1. Section 36-2, Chapter
36, title “Hyattstown", of the
Montgomery County Code 1960,
is hereby repealed and re-enact
ed, with amendments, to read as
follows:
“Sec. 36-2. Annual levy; treas
urer’s duties; bond.
“The council is hereby author
ized and empowered for the fis.
cal year 1950-1951 and each fis
cal year thereafter, to levy an
nually against all the real and
personal property assessed for
county tax purposes within the
area described in section 36-1 of
this Code, a tax at a rate not
to exceed ten cents on each one
hundred dollars of the assessed
value of such property and the
proceeds of such tax shall be
paid annually, in installments
every sixty days, to the Hyatts
town Volunteer Fire Depart
ment, Inc., or its successor, up
on the treasurer of the fire de
partment giving a bond to the
county, to be approved by the
county manager and the county
attorney in a penal sum to be
fixed by them, conditioned upon
the faithful discharge of the du
ties of the treasurer. From the
funds so received, the treasurer
shall pay only such costs, ex
penses, claims and demands as
are necessary and proper to
maintain, equip and operate the
fire department and upon de
mand of either the council, coun
ty manager or the director of
finance, he shall report all ex
penditures from the funds.”
Sec. 2. And be it further en
acted,That this Act shall take
effect August 15, 1963.

The Petitioners pray for the
abandonment of that portion of
Saxton Circle, Owens Street and
Beall Avenue as described
above.
It is,thereupon, this 10th day
