This is to give notice that on
the 19th day of June, 1963, a
Petition was filed in the Circuit
Court for Montgomery County
by the Plaintiffs against the de
fendants whose address is un
known. The Petition alleges in
substance that the Plaintiffs in
March, 1952 entered into an
agreement with Woodbum
Homes Corporation to purchase
Lot 19, Block D, Section 2, of
Silver Rock, Rockville, Maryland
and further, that the Plaintiffs
deemed it inadvisable to take
title to the said real estate in
their own name as a consequent
of which on or about November
6, 1952 the said parcel of real
estate with improvements was
conveyed to the defendants
herein who being intimate
friends of the Plaintiffs had
agreed to take title to the said
property in their names with
the understanding that the pur
chase price, down payment,
monthly payments, or any other
costs in connection with the
said property were to be made
by the Plaintiffs and the defend
ants further agreed to convey
the property to the Plaintiffs
when called upon to do so. The
Petition further states that on
November 6, 1952, the Plaintiffs
paid the sum of $3,490.00 in cash
settlement for the property and
that the defendants executed a
mortgage to secure a loan of
$7,000.00 from the People's Life
Insurance Company of America.
That from November 6, 1952 to
the present time the Plaintiffs
h. ve paid all monthly payments
and all other costs and charges
incidental to the maintenance
and purchase of the property
and that they have further at
tempted to locate the defend
ants in order to call upon them
to convey the property to the
Plaintiffs in accordance with
the trust and understanding be
tween the parties.
The relief prayed in the Peti
tion is substantially as follows:
that the Circuit Court for Mont
gomery County declare a trust
arising from the conveyance of
Lot 19, Block D, Section 2, of
Silver Rock, Rockville, Mary
land from Woodbum Homes
Corporation to Morris and Wini
fred L. Sussman for the use
and benefits of the Plaintiffs
and further that a trustee be
appointed to convey the said
real estate to the Plaintiffs as
tenants by the entirety and for
further relief.
Wherupon it is ordered for
the Circuit Court for Montgom
ery County, Maryland this 15th
day of July, 1963 that the Plain
tiffs cause a copy of this order
to be inserted in a newspaper
published in Montgomery
County, once a week in each of
four successive weeks, before
the 12th day of August, 1963,
giving notice to the said defend
ants whose address is unknown
of the object and substance of
the Petition and warning them
to show cause if any therebe,
on or before the 13th day of
September, 1963 why a decree
should not be passed as prayed.

that on April 21, 1963, the said
Respondent without explana
tion for any known reason, left
his home and has never re
turned, to-wit: said respondent
flew his airplane from Deep
Creek, Maryland at approxi
mately 5:00 P.M. on April 2i,
1963 with the intention of visit
ing Fenwick Island, off the
Eastern Shore of Maryland, and
from that time, neither Respon
dent nor his airplane have been
found, although a diligent
search and inquiry has been
made; that at the time of said
departure, respondent left both
real and personal property, to
wit: insurance policies, retire
ment wages with the United
States Government, a 1960
Austin Healey Automobile, fur
niture, checking accounts, and
certain real property situate in
Montgomery County, Maryland,
being 4018 Halsey Court, Ken
sington, Maryland, and improve
ments thereon, and said Peti
tion prays that a receiver be
appointed to take charge and
control said property pursuant
to the “Uniform Absent Per
sons Act” as more fully set
forth in the Annotated Code of
Maryland.

able to communicate with him
only through a post office box,
Post Office Box 981, Miami,
Florida; that the defendant,
Bogley, Harting & Hight, Inc.,
is a mortgage banking corpora
tion, organized and existing
under the laws of the State of
Maryland, and is the holder of
a Deed of Trust upon the afore
mentioned property, executed
by the plaintiff and defendant
on July 13, 1956, to secure a
promissory note.
The Bill further alleges,
among other things, that the
plaintiff and defendant are the
owners, as tenants In common,
of the hereinabove mentioned
property, and that they are un
able to agree upon the proper
management of said property,
and that it is necessary that the
property be partitioned since it
cannot be divided in kind.
IT IS THEREUPON, this 18th
day of July, 1963, by the Circuit

The object of this suit is to
procure a divorce a /inculo
matrimonii for the Plaintiff
from the Defendant. The Bill of
Complaint states in substance
as follows: that the Plaintiff is
of legal age and has been a resi
dent of Montgomery County for
more than one year next pre
ceding the filing of this Bill;
that the Defendant is also of
full legal Ege and that his last
known residence is Honolulu,
Hawaii; that the parties were
lawfully married on June 26th,
1955 by a minister of the
Church; that the Defendant has
abandoned the Plaintiff, and
that such abandonment has
continued uninterruptedly for
at least eighteen months, and is
deliberate and final, and that
the separation of the parties is
beyond any reasonable expec
tation of reconciliation; that
the parties have two children
born to them of this marriage,
Fagatoto F. Sania and Lauvale
F. Sania, both minors, both
presently in the custody of
Plaintiff.
The Bill of Complaint prays
that the Plaintiff be divorced a
vinculo matrimonii from the
Defendant.
WHEREUPON, it is ordered
by the Circuit Court for Mont
gomery County, this 11th day of
July, 1963, that the Plaintiff
cause a copy of this Order to
be inserted in a newspaper pub
lished in Montgomery County,
once a week in each of four
successive weeks, before the 12th
day of August, 1963, giving
notice to the said non-resident
Defendant of the object and
substance of the Bill and warn
ing him to show cause, if any
there may be, on or before the
13th day of September, 1963,
why a decree should not be
