Why did nt Mr. Bailey look at it Jh figures were there, both d-ht and credit, and did not Bailey lock at the l-ook and a-k Peck why did the 10 come again before the n i k TVrk's instrunienta'itv. This wholo nw "J jtorr is improbable and incred'.hl- Tho story of Bailey is improbable for another reason. Mr. Bt,1e charged the State with the entirt of the allowance of the Board, withont deducting the 45'), although I e says that Peek did not Uke the 450. Iid he do so to get th" money into his own pocket? If so, what is his te-tiiaony good for. He impeaehes him-wif, and ought nol to be believed. If this transaction had been a- lhi!ey atated, why did be not make a memorandum, t- -how that the f45) had been paid. He did not do ho, but charged the State with the whole amount. E. H. Whitney was a singular witness. He changed color like a kaleidcscope. You all saw his agita ted manner his change of color and nervous agitation. He swore to a conversation years ago with this precious Mr. Bailey, and made two learchesfor a slip receipt, covering this sa-ne 150. He swear also to matter of great j ar- ticularily, of great minutenes so great as to 1 make me believe that he has contrived the whole rtorv. So man ran recollect thinn for year as he has stated them. There is no so great proof of contrivance, as the iuiriutenes of the story toll by the contriver. From 1 53 to 1 95 he an-ie these facts in his breast, and all of a sud den, suddenly recollects the whole circumstance, bat he could not name man, woman, or child to whom he told the facts. I believe the whole of Whitney's testimony, to be a fabrication entirely. Mr. Bailev does not reeolht t looking into the ledger. Mr. Wiswell recollecta certain things. He recollects almo-t everything which his friends told him. I do not believe he was present at any such interview. I do not Wlieve any such interview took place. Tho whole testimony is a fabrication, in my belief. The witness Mead pretends that lie saw this famous receipt on the ledger, in 1S53, two years sad more before its pretended discovery by Thompson. Here then again was great and sus picious particularity. He could almost recollect the exact day when ho read a receipt which did not concern him, after a lapse of more thhn two years. He went with Thompson, in January, 1856, he went to seacli the book, and found the receipt. Mead had had thelookinbis hands half time for Tear, yet lie was set to eoarch with Thompson, and when they found it, thej had a celebration. Thompson was happy elevated gorgeous but Mead wa silent. These two witnesses differ cential!y as to the position of the receipt. Mr. Teck, upon being informed of the receipt treats it as a "lip receipt, instead of such an one as they now pretend it was. If the jury do net believe that the receipt in question ei sted on the 19th of August, 1S.V, you must find for the peopie, as Lard and severe as that verdict may be on Bailey, and he will be in fact found guilty of a foul and wicked contrivance. The tnkiag off, and pasting or pining on the receipt upor the book, is suspicious. The misprinting of the receipt in the Journal is another euapii'ious cir- cumstnnce. l"p to the time when Teck cam home, the wholo theorv of his defence consisted ia his having given a slip receipt to Mr. Bailey. Mr. reck his demanded this investigation and it is important that it should b full and thorough. It is doc as well to the State as to the defendant, thnt the whole truth should b eEcited, and a fair and just verdict given. In this investigation Mr. Trek has friends warm Political and personal friends. He mar have had around him some who are not sempulou who haviug concocted extrajudicial affidavits and sworn to them, have now come here to swear the same thing through a jury of Ingham county Thompson carried the book to Jones, with the receipt srrongly wafered to it, m they pretend, but CoL Jones swears solemnly that no receipt was wafered to the book. If Mr. Thompson ha. a motive in convincing CoL Jones, he had only show the receipt, if genuine. There were no wafer-marks upon the book. The contrivance hsd not bee effected. It the receipt had been shown to Jones, that would have been the end of the contest. Mr. Whipple casts a sneer at the fact that the ink was not yet black upon the "tteipt Col. Jones and Mr. Bingham both pos itively swear to the fact, that the ink was fresh and the paper clean, and folded down sharp. Wh these witnesses are experts upon this sub- J If the iuk wit as stated by them, it PuJTCally impossible that the receipt could have 0 written more than two tears and five tocths. Mr. Whipple enquires why Col. Jones demand we money of Bailey. He did so because y had promised to pay the money if Teck ""not. That was the reason. w ny did not Peck allow Bailey to pav the Was there any good reason ? What had pck to do with it, if he never had it, and it did oelongtohim? This makes out a pri- J Jartt case. The defence undertakes to show Peck has only received the sum once. I do intend to comment upon the testimony of Bailey, Whitney, Thompson and WiawelL It is for you to consider and weigh the testimony of fered by the defence. It is the conviction oi truth, in your minds, which must govern, and not the words or sentences of the witness. It is for you to judge by the manner of the witness, by other circumstances in the ca.
