Morris, Martha Carman, And’w Carman, Re becca Carman, David Carman, Abra ham D. Morris, Elizabeth Amos and Edward Amos vs. Jesse Morris, — In the Circuit Court for Baltimore county—in Equity. The object of this suit is to procure a Decree for the appointment of a Trustee to convey unto the complainants all the right, title and interest of the Defendant in and to a certain tract of land in Baltimore county called “DREARY WILDERNESS," containing about fifty four acres, or forthe pas sage of a decree for the sale of said land, the proceeds to be devided among the complai nants according to their respective interests. The Bill states that the father of the com plainants, Joseph Morris, now deceased, and the defendant, owned in common, a certain tract of land in said county containing about seventy-six acres, of which the above mention ed is a part; that in the year A. D., 1826, the defendant and the said Jospeli divided thesaid seventy-six acres among themselves, that the defendant took twenty-two acres, and the said Joseph the balance, which is particularly de scribed in the Bill, and its accompanying ex hibit ; and the said Jesse Morris does not re side in the State of Maryland and it is not known to the complainants whether he is alive or not. It is thereupon this 14 thday of March, A. D., 1865, adjudged and ordered that the complai nants by causing a copy of this order to be in serted in some newspaper published and print ed in Baltimore county once in each of three successive weeks before the \sth day of April, 1865, give notice to the said defendant of the object and substance of this Bill, and warn him to appear in this court in person or by solicitor on or before the 16 thday of July next, to answer the premises and show cause if any he has why a decree ought not pass as prayed.
