corporation duly organized and exist
ing under and by virtue of the laws
of the State of New Hampshire) as
Trustee, as mortgagee, which said
mortgage i? dated the first day, of
June, A. 19f5, and with a power of
sale therein, contained, was duly filed
for record in the office of the Register
of Deeds in. and for the County of
Cook, in the State of Minnesota, on the
first day of July, A. D.. 19X5, at 9:30
o'clock A. M., and duly recorded in said
office ,in Book "F" of Mortgages, on
page 251 and pages following and
Wliereas the said Northern Land and
Lumber Company. Marcus F.: Bates
and Daniel D. McDonald are in said
instrument sometimes referred to for
brevity as grantors and
Whereas the said Alice Reed Bates
and Mary E. McDonald each respect
ively united and joined in said mort
gage for the purpose of releasing all
their rights under the statute or other
wise as the wives of their respective
husbands and in order to consent to
and confirm said mortgage and
"Whereas the said mortgagee in said
mortgage is in said mortgage some
times referred to for brevity as "Trus
tee" and
Whereas said mortgage mortgaged
and conveyed the property and premis
es mortgaged and conveyed by said
mortgage, to secure the payment of
notes the principal amounts of which
aggregated the sum of Two Hundred
Fifty Thousand ($250,000.00) Dollars,
and bearing interest at the rate of five
(a) per cent per annum, pay
able annually and said mortgage also
secured the various items hereinafter
claimed as due under said mortgage
and secured thereby and
Whereas said mortgage provided that
if default .should be made in the pay
ment of'any installment of interest or
of the, principal of the notes secured
by said mortgage or in the payment
of any of the taxes, assessments or
charges in the nature thereof, or if
default should be made in any of the
terms, conditions or covenants of said
mortgage, and such default should con
tinue for a period of six months after
notice of such default, and demand by
the said mortgagee should be made in
writing upon the said Northern Land
and Lumber Company. Marcus F. Bates
and Daniel D. McDonald to pay, fulfil
or perform the same, then the said
Manchester Safety Deposit and Trust
Company might and should upon the
written request of the owners or hold
ers of ten or more of said notes, the
principal sums of which should aggre
gate at least the sum of Ten Thousand
($10,000.00) Dollars, declare the prin
cipal of all said outstanding and un
paid notes with interest thereon at the
rate of five (5) per cent per annum
and all charges, amounts and sums of
money in any way whatsoever secured
by said instrument, at once wholly due
and payable and
Whereas such default occured in re
spect to the payment of interest on
the notes secured by said mortgage
'and the said Manchester Safety Deposit
and Trust Company duly served notice
of such default and demand for pay
ment as in said mortgage provided
and
Whereas such default continued for
a period of more than six months after
such' service of notice of such default
and still continues and
Whereas after the expiration of six
months from the service of such notice
of default the owners: and holders of
more than ten of the notes secured by
said mortgage the principal sums of
which notes then and now unpaid ag
gregate the sum of more than Ten
Thousand ($10,000.00) Dollars, directed
and requested the said Manchester
Safety Deposit and Trust Company in
writing to declare the principal of all
outstanding and unpaid notes duly is
sued and secured under the terms and
provisions of said mortgage, with in
terest thereon at the rate of five per
cent per annum and all charges,
amounts and sums of money in any
way whatsoever secured by said mort
gage due and payable and to immedi
ately commence foreclosure proceedings
to foreclosure said mortgage and
Whereas said Manchester Safety De
posit and Trust Company, as Trustee
as aforesaid, mortgagee in said mort
gage, has duly elected and does hereby
elect to declare the principal of all out
standing and unpaid notes duly issued
and secured under the terms and con
ditions of said mortgage, with interest
thereon at the rate of ..five per cent per
annum, and all charges, amounts and
sums of money in any way whatsoever
secured by said mortgage due and pay
able at the date of this notice under
the terms, provisions and conditions of
said mortgage and
Whereas there is actually due and
claimed to be due and payable at the
date of this notice on the notes secured
by said mortgage the sum of Two
Hundred Fifty Thousand ($250,000.00)
Dollars, with interest thereon at the
rate of five per cent per annum from
the first day of June, A. D. 1915, which
interest amounts at the date hereof to
the sum of Forty-one Thousand Four
Hundred Fifty-eight and 33/100 ($41,
458.33) Dollars, making a total amount
due and claimed to be due oii said notes
secured by said mortgage for principal
and interest at the date hereof the sum
of Two Hundred Ninety-one Thousand
Four Hundred Fifty-eight and 33/100
($291,458.33) Dollars and
Whereas said mortgagee, said Man
chester Safety Deposit and Trust Com
pany, as Trustee, has in accordance
with the terms, provisions and condi
tions of said mortgage paid and ex
pended the sum of $354.40 in paying
fkiecessary expenses incurred by it in
connection with the performance of its
duties under said mortgage, which
amount so paid and expended is by the
terms of'said mortgage an afclitional
lien under said mortgage on the prem
ises and property mortgaged by said
mortgage and secured thereby, and
which said sum the said mortgagee has
duly elected and does hereby elect to
declare due and payable -at the date of
this notice under the terms, provisions
and conditions of said mortgage and

thereof, on or immediately after March

road and equipment and each and

IT IS THEREFORE ORDERED, that
hearing on said petition be held at the
Commercial Club Rooms. Duluth, Minn.,

Haywood, with 95 fellow officers of the W. was found!
guilty of interfering with the prosecution of the tyar and viol
tion of the espionage act. He was sentenced to twenty yet
in prison in the Federal penitentiary at Fort Leavenworth and?
fined $20,000. *J

tified by Haywood.
This correspondence is published for the information
the people and explains the stand taken by the Public Safet^
Commission, pertaining to certain dangerous and unpatriotic^
activities within the State of Minnesota.

Dear LeSueur: On June 5th between forty and fifty mem
bers of the I. W. W., with Socialists, numbering in all 135, re
fused to register at Rockford, Illinois.
These men marched in a body to the jail and gave them
selves up to the sheriff, saying they declined to register and
ha4 come to go to jail for the offense.
They were locked up. Later I understand a number were
badly beaten by deputy sheriffs and jail guards.
I learned this morning from a Scandinavian Socialist here
in Chicago that the cases are coming up on June the 19th. The
Socialists have asked us to coroperate with them giving the
men a defense, to which of course they are fully entitled to.
The man whe telephoned me mentioned Stodman of Chicago
as a possible lawyer. I told him that if we were going in on the
case, I much preferred you to represent the interest of our boys,
and I would write you to see if you would handle the case.
Will it be possible for you to look after the interests of
Jthese members, and what would be your fee?
As the case now stands, it is, I believe, merely a misde
meanor, though they have one man, George Cully, under arrest
charged with conspiracy, and of course there is no telling how
serious the other cases may develop.

Dear Fellowworker: Your letter written on the 13th of
June caught me this minute at St. Paul. It was delayed in Fort
Scott. I sure would have enjoyed taking a stick in those cases
and I hope I have not thru failure to receive your letter, pre
vented the boys from having real counsel in the cases.
Of course, other arrangements have been made by this
time. I wil| be at the address given above. 1 have resigned
from the school and will get mail addressed hereJnore promptly.
I hope things are moving along well with you. I look for
trouble on the Minnesota Range when they begin prosecutions
of the "Slackers'' as they call them, for there is a bunch of real
scrappers there. Many of them left their native land to escape
military conscription and will not lightly forego their personal
liberty here.
Being interested in iron as much as it is interested in men,
the Government will be put up against a hard game to play in
case of a strike, and there is no telling what would develop,
I hope that the Department of Justice will realize that hav
ing enough registered for all purposes it had better quit and aid
the government in the prosecution of the war, rather thim to
make war at home on these workers, but they may decide to go
thru. There is no power on earth so prone to blunder as ignft.
