The petition of E. E. Nortton, of tiie city of New
Orleans, herein appearing as the assignee in bank
ruptcy of the estate of Jacob Young, bank
rupt, respectfully represents that, among the
assets surrendered by the bankrupt, and belonging
to the aforesaid estate in bankruptcy, there is tiie
following described real estate, situated iu the
State of Louisiana, in the parish of East Baton
Rouge, to wit:
1. A certain piece or parcel of ground, situated
in that part of the city ol Baton Rouge laid out by
Elie Beauregard and designated on the plan thereof
as the western part of lots numbers four and five,
of square number forty, measuring sixty feet
front on Africa street, by one hundred and twenty
feet along St. Charles street, together with all the
buildings and improvements thereon.
2. A certain half lot of ground, in that part of
the city of Baton Rouge laid out by K. Beauregard,
being the west ha f of lot number five, of square
number thirty-eight, together with all the build
ings aud improvements thereon.
3. Two certaiu lots of ground, in that part of the
city of Baton Rouge laid out by Elie Beauregard,
and designated ou the plan thereof as lots num
bers one and ton, of square number forty-six, to
gether with ail the buildings aud Improvements
thereon.
Your petitioner further represents that the said
hereinbefore described real estate is, as appears of
record, incumbered aud charged with the follow
ing hereinafter specified mortgages, judgments,
liens and privileges rearing thereon, to wit:
Mortgage in favor of Janies A. Payne for $730.
Mortgage iu favor of Joseph G. Bovntero for
$2107 id.
Mortgage in favor of John O'Connor for $650.
Mortgage in favor of James A. Payne lor $872 82.
A twelve mouths' bond, secured by mortgage,
for $323 50.
Judicial mortgage in favor of Margaret Moran

Wherefore your petitioner prays that he may 1*
ordered and authorized to sell said property alcove
described at public auction, free and clear tiffin nil
incumbrances. That all said judgments, mort
gages, liens aud privileges recorded against said
property be canceled and erased, so t-liat vour pe
titioner can convey a clear aud unincumbered
title to anv purchaser thereof, reserving to said
James A. Pavne, Joseph G. Bouytero, John O'Cou
nor, Margeret Moran, wife of bankrupt, Rudolph

second of August, 1855, and which lot measures, in
American measure, fifty-one feet six inches and
three lines front on Co iseurn street, by one hun
dred and twenty-eight feet two inches deep, be
tween parallel lines.
3. *A CEBTAIN PIECE OR PORTION OF GROUND,
situated iu the Fourth District of this city, in the
square bounded by Apollo, Second, Bacchus and
First streets, measuring one hundred and fifty feet
on each of Second and First streets, and two hun
dred aud fifty-three feet ip depth and front on Bac
chus street, between parallel lines, with the build
ings' and improvements thereon, as per plan of
Hugh Grant, engineer, on the twenty-ninth of
March, 1849, and deposited as plan number eighty,

4. THREE LOTS, situated in the last mentioned
square, on a sketch annexed to an act of sale to

Terms—The purchaser to assume the pavtnent of
a promissory note for five thousand dollars dated
first March, 1371, payable two years after date, and
bearing interest at the rate of eight per cent from
date until paid, diawn by William Henry Waters
to his own order, and by him indorsed, secured by
mortgage on said property; also, to pay attorneys*
fees at the rate of five per cent incase of suit on
said note, and to keep the buildiugs on the prop
erty insured against hre, and transfer the policy to
the holder oi said note. Tiie whole in accordance
with tiie stipulations of tiie act of sale from George
Cronan to W illiam H. Waters passed before William
B. Kieiupeter. notary public, on the first March,

facias to me directed by the honorable the Fifth Dis
trict Conn for the parish of Orleans, in tiie above
entitled cause, I will proceed to sell at public auc
tion, at the Merchants and Auctioneers' Exchange,
Royal etreet, between Canal and Customhouse
streets, in the Second District of this city, on SAT
URDAY, 5Iay 4, 1872, at twelve o clock M., the fol
lowing describee property, to wit—
A CERTAIN LOT OF GROUND, together with
tiie improvements thereou, situated iu the fau
bourg Livaudais, in the Fourth District of
this city, and designated as lot number niue
of the square number two hundred and eighty
seven, comprised within First,' Second, St. Denis
and St. Patrick streets, on a plan made bv Albert
G. Blanchard, deputy surveyor, ou the twentieth of
May, 1852, deposited iu the office of W. II. Peters,
late notary public; the said lot forming tiie corner
of Second' aud St. Denis streets, and measuring,
American measure, as per said plan, twenty-six
feet four inches and three lines front on St. Denis
street, hy one huudred afid ten feet in depth and
