NASHVILLE. Tenn., Jan 25 - The
work of Jury picking in the Carmack-
Cooper * use was resumed here this
morning, seveial bundled talesmen
appearing in court in response to the
summons on trie second venire of 5 -0
names drawn for this cuae A clash
occurred between opposing counsel
over the* effort of the state to force
u hearing on the affidavit* affecting
the competency of Juror Leigh. The
state gave notice lhat the juror would
h»- attacked for having expressed an
opdilon as well as on the grounds of
alleged drunkenness and gambling,
in view of the fact, however, that a
large number of men summoned for
Jury service were in court, Judge Ha t
decided to proceed first with Jury
picking. Each side then retired to
look over the fourth panel, containing
75 names.
The seventh Juror. J H. Vaughn,
was secured shortly before noon. He
Is a farmer living south of Nashville,
lie has a family aud < an neither read
nor write.
Anew feminine face in the court
room today was that of Mrs. Beverly
Wilson, of Mobile, Ala., youngest
daughter of Col. Cooper.

TELLS HARD-LUCK TALE
Jacob Freedman told a hard luca j
story In Judge Donovan's court Mon
day morning when he appeared with
his divorced wife, Goldie, who was
pressing for alimony.
"When my wife left me she took all

mer s savings Then the hard times
ruined my peddling business, and the
t costs of tne divorce suii which she

to pay her lawyer, and to raise the

of a doaen men, all members of the .
Majestic club, so-called, for gambling.
The men were taken from a room ovor 1

morning. In a raid by Detectives Reid,
Good. Wllsou and Black and Patrol
man Uekur. Nine of the party were
registered and locked up on "sui
plclon." but were released later by
order of Police Justice Jeffries to ap
pear In court, Monday morning. They

ney Percy Grose, but no officers ap
peared to aak for warrants and they

"It was not our men’s business to

this morning." said Capt. Baker. "No
complaints had been made and their

ing They were registered merely as
suspicious persons. We are going to
ask complaints against them for
gaming, but until that was done there
was no use of our going to court."
"Gaming is nothing more nor less
than disturbing the peace," said Jus
tic © Jcffr iiH, "and 1 supposed, of
course, the offi< ers would be in ear'y
this morning to swear out complaints
| to that effect so I could try the men
in the early session. Tills was not
done until later in the morning, when
I was busy with other work, und I
asked the officers to me me tomor
row. I have no row with the police on
this score, and don't expect to have
any. 1 will Insist, however, that If
warrants are Issued that the three nu n

sioner be included. What right has

The names ot the three men not

size up those who passed and admit
them If satisfied they were member*.
Patrolman Maik Baker, attired in
plain clothes, got by the guard without
difficulty. The detectives were close
i» hind, and before any of the "mem
bers ' knew what was up tr.ey were
surrounded, and were obliged to look
» n helplessly while the officers gather

r After leaving the police court, Mon
day morning, the ulue who hud been
locked up and 1 cleaned, were piloted
to Capt. Baker's office by Atorney
Grose, who demanded the return of

were accommodated. One of the men,
who answered to the name of John
Gray, No. 326 Momoe-ave., attempted

"It is a sort of ;t club to me,” he
