Baker protesting against the method of planting trots on Dexter boulevard and referred to this department, 1 have to say that by authority of Beo tlon 1, Ordinance 29ft, the planting of trees along Dexter boulevard wa* done The section referred to reads as follows: “The Department of Parks arid Boulevards shull have power and con trol over all trees, shrubs and plant* planted, or to be pjanted In the streets and public hlghwu>s In the City of Detroit and the power to plant, prune, spray, cultivate, preserve and other wise maintain such trees within the confines of the public highways of the City of Detroit. Section 9 also says “No person, firm or corporation shall plant In any street or public highway a tree at a distance of less than 25 feet from any other tree, or at a distance of less than two feet from the established sidewalk line of said street except upon a written permit first obtained from the Department of Parks and Boulevards." As stated In the petition, verbal no tice was served upon the people liv ing oh Dexter boulevard of our inten tions to replace some of the trees and to plant where none wrere already lo cated. This was a matter of courtesy and not because of uny obligation to do so. The size of the tree was not mentioned. In placing the trees an attempt was made to keep as near as possible a uniform distance between, and In the block referred to eight trees were planted on each side with spuces be tween of 31 feet. 31 feet. 32 feet. 32 feet. 33 feet six Inches. 32 feet seven Inches. The distance of 33 feet six inches was made necessary because of an automobile driveway There w'ere a few cases where Inex pensive planting had to be changed or rearranged ami in such cuses the work was done by our men and tin- prop erty owner consulted. Relative to lot No. 112. on which your petitioners lay great stress, we find that the owner some time ago had gone to the expense of one hundred dollars to plant two 8-lnch elms In fronts of his property This property has 60 feet 2 Inches of frontage His trees were planted 23 feet 6 Inches apart, w’hlch was not satisfactory to us. They were transplanted at a dis tance of 32 feet apart and left In front of his own property. He thus merely retained what he already had and paid for and secured from the city nothing In addition. Each of your petitioners retained, in some manner or other that which they already had and In addition had placed in front of their property a four-inch elm tree. It Is the policy of this department not to consider the Individual property but rather the beautification of the streets as a whole, in fact, in at tempting the beautification of the City we could hardly afford to take Into consideration the claims of u single Individual as In many cases the indi vidual W’ould nrobably be obliged to sacrifice something or other wh* re the community as a whole Is to be bene fited.
