In the rear yard of a larsro Jivcry stable,
in Tlilrtccntji street, near University place,
in a deep, sunken stone ranlt, lies tho body
of Jacob J. Aril tin, once a prosperous
Knickerbocker farmer. A plain stone slab
lying flat on the ground, BPn uica the
tilth art! litter of the stable have accumu
lated, is all that marki his grave. Ilia farm
extended from what is now Fourth Avenue
nearly to Sixth Avenue, and from Eleventh
Htrect to Fourtenth street. Ho had aUo
paaturct between the modem bonndenes of
Sixth and Eighth Avenue, and Thirty-first
and Thirty-third street", and owned other
property in Manhattan Hand. His liomc-vtt-ad
stood in Thirteenth street, between
Wroadway and University place, until about
forty years yo, w hen it was torn down.
Mr. Ardtn dicd iu 1801, leaving a wife
find one sou, Dr. Jacob tf. Ardcu. ilia wilt
provided that the iroperty bhoitld ulways
Im! held by tho Ardcu family, and while
hid wife and son Were permitted to ut! it
during their lives they were debarred from
ncllio it, and in tho event of hid son's
dying without heirs the property was to fall
to Joan bummers, a nephew of the testator.
Dr. Anion married, and Mr. Bummers, think
ius that hi chances of iuherituiir the estate
were alight, bold out hU ropectivc title to
nr. A.ruen lor fjuw.
Then Mrs. Jacob J. Ardeu, regardless of
the stipulations of tho will, began to sell
the landH at prices that attracted ready
buyer, Blic ul.to mortgaged a iargo part
"of the property to John Jacob Alitor, Judge
lames ltooM.-v.it and other, and at the ex
pirationa of the mortgage Alitor and Roose
vclt foreclosed and took possession of the
land. Judge Kooecvelt had a bouse on tho
Tropcrty at tho time of hia death.
Dr. Ardcn died about 1S24, and ' hia
mother a year later, leaving to her own
family the remnant of the property that she
had not sold or mortgaged. To the widow
of her son she left not a shilling.
This arbitrary dinpohul of the property in
iieiiance ot tho conditions or tho will was
of counts not satibfactorv to the relative of
.Jacob J, Arden, and they took steps to re
cover their luudc. They instituted a suit
in 1823 against the purchasers of the land.
and employed Col. Aaron Burr as their at
torney. Col. Burr was confident of success,
but his effort were frustrated, as one of the
heirs, John Brown, upon whose energy and
wealth the prosecution depended, fell dead
in the court room in a tu, ana I us wile ro.
fused to carry the suit further, and the
other claimants were not able to press the
case. Then it rested for years.
The suit was renewed in l't, and tried
in the United States District Court before
Judges Nelson. aud Emmet in September
1853. Ex-Chief Justice Bronson, ex-Judge
Ik'finHley, W illiuui Curtis ISoyes aud Lion.
Levi Chatlii-ld were attorneys for the prose
cution. The judi'c, onu of whom then
lived iu a house ou the disputed proterty,
decided a-'uiu-t the heirs, but required that
the cii-so hliould be taken to Washington, as
it was ol too great nuportaiice to be settled
by him. The case slept iu the District
Court for three years without result, and
the plaintilfi charged that their attorney
had been bought oil for $'.Vj0,0U0. Thusuit
is again to be vigorously prosecuted by tho
heirs, through Rebecca llowland, the last
living uiecu of Jacob J. Ardcu. The prop
erty is valued at more than S0, 000,000.
Jacob J. Ardeu's will ordered that his
tomb iu Thirteenth street should always be
kept by the family as a burial place, with
the right of way to its portals. Tho path
that now leads to it is the hallway for livery
horses. The bodies of Arden's two ser
vants, one a negro aud the other an Irish
man, who saved the life of his muster in the
Bevolution, lie with his under tho neglected
stone slab. Alio York Hun.
Peter Cooper First Amerlr.au Locomo
live. "On a recent trip down to tho bay of New
York," oays the editor of the Brooklyn
I ii ion, "we turned w ith the venerable Peter
Cooper a pape of tho opening railway era
of America.1 " Mr. Copper, he claiina, de
serves the honor, among tho other honors
of his useful life, of being tho first to in
troduce into actual service the railway en
gine in America. We condense from the
very animated and interesting sketch of Mr.
Conner's rcminiscencus:
"Think of the excitement that pervaded
the civilized world w bcu it was hcttlod that
the Darliug'ou Uailway, which was openod
to suoply Loudon w - it Is coal, iiuu actually
becuu to tarry ustU''ers by steam at seven
miles per hour. But we are able to correct
tho reminiscences of that occasion which
shared tho commou mistake that the suc
cess of the Liverpool mid Manchester Kail
way Ktiiflulatcd the introduction of rail
roads into this country, for some of the now
u.ost iniKrUut roads iu this country were
projected and commenced before the Liver
pool and Manchester was built. It received
with -them the stimulus of the first road
above named. In 18,'H Mr. Cooper was in
business iu New York, hia native place.
His mother and grandmother were both
born on the present sito of bU Paul's
Church, Vesey street aud Broadway, and
his mother remembered seeing the stockade
still standing w hich had been erected to
keep the Iudians out of tufunt New Amster
dam. Mr. Cooper had bought as a specula
tion the entire magnificent tract in Balti
more bow owned by the Canton Company.
Baltiiuoie was then a city of To, 000 people,
rich and prosperous, and had entered upon
the railroad era. On July 4, 1828, the corner-stone
of the Baltimore and Ohio Road
was laid with imposing ceremonies by
Charles Carroll, of Carrollton. It was
pushed energetically, a little too much so,
for when thirteen miles had been finished it
waa found that in turning the rock to save
cutting, such short curves had been intro
duced that tho experts declared the lino
utterly useless. It could not bo used by
steam. Five per cent, bad been paid in,
and shares had leen sold at 17, such w as
the zoal and confidence of Uie people. But
'the chill was immense, and; everything
stopped. Mr. Cooper, then thirty-eight
year of age, saw new disaster to himself in
- the depreciation of his tract should the road
fail, lie proposed to tho directors to con
struct au cngino that should be available on
their line, 'f hey www willing, but incred
ulous. Ho brought down from hia glue
factory In New York an engine with threo
and a half iuehes cyliudcr and fourteen
inches stroke, procured wheels and other
appliance from the railway company and
presently rolled out upon the track the first
American railway engtuc The tttal trip
was to take placo the next day. - That bight
a thief stole all the cooper and bran fruin
the infant machine and caused some further
delay. The trial trip was run, Mr. Cooper
himsVlf actiug as tuginecr; and when hia
whvrsy Uulo baby locomotive threatened to
lose too much stvsim he held dow o the safety
valve with his own hands. The run was
made with thirty iwscngvrs, thirteen utiles
" in one hour, aud Baltimore was happy.
' Compare the little engine of forty-seven
years ago with, the ponderous machines of
tnt-day, and yet they folic on the pathway
tho little engine opened."

having tailed as fur south as within !!W

largo collection of Aumraliau animals and
bo'auical seciuicus. Among the former is
a wombat, a diminutive bear; also a feroci
ous little bcabt appropriately named Tas

several kangaroos, a small animal with
claws like those of a mole and a snout re
sembling the biil of a duck, and a variety
of other curious-looking creatures.. The
botanical collection includes, among other
strange specimens, about forty varieties 'of
fern, one of which measures no lees than
twenty feet iu height and two in diameter.
A great portion of the route traversed by the
Swatara, it is fctated, was never before sailed
over by an American war vcstcl. Her re
ception at such places was an enthusiastic
one, and the oJliccrs speak iu terms of high
praise of the hospitable manner in which
they were received by the English colonists
in Australia, who very geuerously assisted
the expedition in various ways. The gov
ernment is supported by a population ot Jess

not grumble about taxes, because their
taxes are honestly collected and honestly
disbursed. At Melbourne every door was

If anybody has seen a black-and-tan dog
auswering to the name of "Judge," going
down the street w i'.h a hard shell turtle that
wou't answer to anything, and certainly
won't answer to tackle as the dog will tell
you, if you cau only get him to stop long
enough please to halt the eloping pair, as
they are property of the editor of this paper.
We arc fondly uttachud to the dog ou ac
count of his vagaboudish, Bohcuuunish
habits. He knows every dog in Peoria by
uauie, and is ou sw"skiug terms with nine
tenths of tho dogs that come iu under the
wagons, aud he knows more of the inhabi
tants of this city than the tax collector does.
Tho turtle is a more recent acquisition. It
was pluccd in the back yard yesterday, and
the dog spent au hour aud a half trying to
induce it to come out of its shell ana be
comfortable. The old iron-clad maintained
his reserve, however, until the dog orna
mented his nose against the forward part
and coinuicuced to stiiil. The pair seemed
to come to some understanding at once, for
the dog made an impetuous remark on a
very high key, and then they both started
ou a trip together. The dog was last seen
sauntering aiong like a whirlwind, the turtle
staying right behind. We should be very
sorry to lose the dog now, as he has acquired
another important and valuable quality. He
knows more about turtles than any other
dog in'the country. rtoriii Itevieie.'
Peksoxal Appearance of Washington.
The ersonal appearance of Washington is
thus described iu an article on "Washington
in Cambridge" iu the July Atlantic:
. "On the morning of tho third of July the
patriot soldiers were drawn upon Cambridge
Common, and Washington, with a numer
ous suite, rode from bis headquarters, and
under the branches of the ancicut elm
wheeled Lis horse, drew his sword, and
formally assumed the command of the Con
tinental army. A multitude of people men,
women ana chiklreu bai assembled to be
hold this' military pageant, aud to look upon
the Virginia chieftain, whose fame had pre
ceded him. They saw a man forty-three
years old, " aboUt six feet two inches in
height, of well proportioned figure, with
large hands and feet,- with a somewhat
florid complexion, a profusion of browu hair
brushed bttck from the foreltcad, aud blue
eye which wcrevciy far apart. .His whole
appcurance was dignified and commanding.
He wore a blue coat w ith bull facings, and
buff small-clothes, a rich, epaulette on eacli
shoulder, and a cockade ou hut liat.'-
Mr. Bkki heu had this joke on Mr. Evarts
in his last Sunday s sermon: "There is
another clement to w hich I w ish to call
your attention. I find, somehow or other,
from Sunday to Sunday, that I preach
longer sermons. I don't think this arises
troax only preaching ouo sermon each Sun
day. 1 fear that it is cvil communications
that corrupt good manner,' aud that long
fcechcs arc infectious.';
