Col. Roosevelt is sailing down the Nile, and certain parties about the White House feel a sense of uneasi ness. 10-DECISION YET IH TRUST CASES Decision in Tobacco and Standard Oil Cases Expected to Cover Same Ground Essentially Kindred. Attorney General Wickersham, in his motion to advance the hearing of the latter case, described the two as essentially kindred, and suggested to the court that they be considered to gether. Lawyers here generally concur in the statement made by Mr. Wicker sham to the court, that these two cases together present for its consid eration "practically the entire range of modern industrial organizations ln this country." and substantially every feature of the "trust question," so far as it falls within the purview of the Sherman anti-trust law. Yet they are not precisely alike; inded. The two cases are alike in that they are proceedings in equity to enjoin alleged violations of the law of the land neither is in its essence a crim inal action; in neither does the gov ernment seek to procure either im prisonment of individuals or exemp lary fines upon the defendants. In both suits the charges pressed are those alleging unlawful combination and conspiracy in restraint of inter state trade and commerce, and, con tinuing monopoly or attempted mono poly; of important elements in inter state commerce. The Stands.rd Oil company of New Jersey is attacked as a "holding com pany." Out of its $100,000,000 capital stock, orer $97,000,000 was exchang ed in 1899, according to the govern ment figures, for stock in nineteen other corporations, engaged in the various branches of the petroleum bus iness, owns its own shops and sells the manufactured products. In the case of the Standard Oil company, the raw product is to an extent pro duced by the corporation; in that of the tobacco combination the raw ma terial is purchased. While the Sherman law does not speciflcially prohibit the organization of holding companies, the supreme court declared in the Northern Se curities case that the holding, com pany constituted an organization in restraint of trade and commerce. The government charges that from the time of the oragnization of the Standard Oil company ln 1899 a mon opoly was obtained; that in fact for years prior to that a virtual monopoly had existed, and that the various forms which the consipiracy alleged against the oil company has taken, have been merely adaptations to the changing needs and conditions of the times. In the tobacco case it is alleged that originally when the merger was con summated in 1890, there was a luon poly only in the cigarette trade; the defendants claim that the control of the business then secured has since materially dwindled. The Standard Oil's counsel have contended that the corporations which in 1899 entered Into the .greements complained of had long since cejsel to be competitors. In the tobacco case, the defendants contend that their acta have "been confined men.ly to the acquisition of manufacturing property; that manufacturing corpor ations are under no legal obligation to compete the ' prohibition being against specific agreements to sup Mm, Mm, Flannelette Kimenas in all color combina tions, made in the best possible manner. Another difference between the two cases lies in the fact that the Stand ard Oil company is charged with of fense against the Sherman law alone; the Tobacco corporations are charge ed with offending also the Wilson tar iff act of 1894, which extended the application of the anti-trust law to any conspiracy in restraint of trade, one party to which was an importer. Furthermore, the government is seek ing to establish the rule that a cor poration entering into an agreement abroad which in purpose conflicts with American law, gains no immunity from the fact that such an agreement is lawful in the foreign country. It is suggested that the commodi ties handled by the Standard Oil company may be more properly call ed "necessaries of life"' than those dealt in by the tobacco corporations. Attorney General Wickersham in his argument of the Tobacco case ex pressed the opinion that a different element would enter into the trade in an absolute necess'ty of life, as dis tinguished from one that was not a necessity, because such a commodity "was charged with a public use, just as much, if not more, than what is called public utility companies." As the result of the hearing in the circuit courts, other differences were either made or became apparent. In the tobacco suit, the court did not find sufficient evidence to hold that there was a rdonopoly in the trade in question, although it did hold that there was a combination in restraint of trade. In the Standard Oil case, ths court was unanimous in finding that there was an illegal monopoly, in addition to there being a conspiracy. WHITE OAK SCHOOL ITEMS.
