Say Mexican Government Is Not Prosecuting Charges Guthrie, Okla., Feb. 9. Grimes, now being held here for extradition to Coahulla, but that the United States government Is prosecuting them through special attorneys, and that the entire propo sition la prostitution and abuse of the extradition treaty, are the declaration made by the attorneys representing Chapman, Brown and Grimes In an application filed with Judge John H Cotteral late yesterday asking writs of habeas corpus and certorarl. The at torneys for the trio In this proceeding are B. B. Blakeney and Jos. Adams, of Shawnee. It Is the general understanding that Judge Cotteral will grant the writs. Tne first will admit the defendants to bail until the entire proposition is ' finally passed upon by Judge Cotteral and the latter permits him to make a complete review of the entire case. In all probability they will be per mitted to make bond tomorrow, thus securing their release from the fed- eral jail here. An attempt was made to affect their release last night, but the time was not sufficient, and the attorneys will remain here over today for that purpose. It is also set forth in the applica tion for the writs that the defendants are United States citizens and there fore not subject to extradition; that If any offense was committed It was com mitted Jointly in the United States and Mexico, and extradition does not therefore lie because the cases can be tried as well in the United States as in Mexico; that the evidence of criminality presented does not Justify the defendants being held for extra dition; that they are not fugitives from Justice because the alleged of fenses were committed, if at all, Joint ly in both countries; that the prose cution for the offense is barred under both the Mexican and Oklahoma stat utes of limitation; and under Judge Cotteral's recent decision, holding void the Kickapoo land deeds, on the ORDINANCE NO. 891. It is further ordered that the City Marshal of the City of Vinita, Oklahoma, shall give notice to the owner, agent or occupant of all lots, parcels or pieces of land abutting up on the above ordered improvements in the manner provided for by ordinance, which notice shall describe each lot by its number, and shall notify him that the City Council has ordered said im provements and that same be con structed or the cost of building the same paid Into the City Treasury of the City of Vinita, within ten .days from the date of the service of such notice. Section 5. Be it further ordained by the Mayor and Councilmen of the City of Vinita, Oklahoma, that should the owner or agent of any lot or par cel of land liable to taxation for the above ordered improvements, as pro vided for by the ordinances of the City of Vinita, fail to construct said improvements as herein . provided, to pay to the City Treasurer of said City within ten days after the service of such notice, the cost of building the same, that the City Council of the City of Vinita shall thereupon make and enter into contract, for the con struction of the above improvements in the manner and under the provis ions prescribed by the ordinances of the City of Vinita, Oklahoma. That the above ordered improve ments shall be constructed and all matters incident to said construction shall be performed and done in strict compliance with the ordinance of the City of Vinita, relative to the con struction of sidewalks. Section 6. ' That the provisions of the ordinance shall not apply to or be binding upon the owners or agents of property in front of which improve ments have been ordered where such improvements are already built and conform to the plans and specifica tions for the construction of sidewalks as now fixed by ordinance. Section 7. For the reason that pub lic necessity demands the immediate construction of the above described improvement an emergency Is hereby declared to exist by reason whereof it is immediately necessary for the pre servation of the public peace, health and safety that this ordinance shall be in full force., and effect from and after its passage, approval and publi cation, and it is so ordered.
