PLAIN TALK FROM THE IRATE YANCEY ASSISTANT COUNTY ATTORNEY TELLS COMMISSIONERS CON STABLE SHEA IS GRAFTER. Timothy Shea, the constable of Judge Neenan's court, was today cited by the county commissioners to appear at a fu ture date before that body and show cause why he should not be removed from office on several charges preferred against him. The citation was issued at the in stance of Assistant County Attorney Yancey. Mir. Yancey filed charges yesterday and appeared before the county colmissioln ers again this morning in relation to Shea, and the citation was the result of a demand for a delinite answer as to what the cotmmissioners would do in the pgmnises with his charge against Shea preferred yesterday. Mr. Yancey talked very plainly about Constable Shea to the commissioners. lie asked what would be done as to his charge that Shea had been convicted in a justice court of exhibiting a deadly weapon, and the commissioners replied that they would have Shea come in to an swer the various charges of grafting ltade at different times in the p-,t two or three months. Very Plain Talk. Mr. Yancey replied: "Well, he'll come down here and deny that he grafted and you will not do anything. Theni he will walk down town and before he gets four blocks, will tell five men how he pulled the wool over your eyes." The commissioners stated that tery would give Shea his day in court, any way, and Mr. Yancey said that his charge would be confined to the conviction in Arnold's court against Shea for drawing and exhibiting a deadly weapon. A communication citing Shea to ap pear before the commissioners on August 19 at 2 o'clock to show cause why he should not be removed, not only on the ground of his conviction for a misde meanor in the justice court, but upon all the other charges of grafting, more or less indefinite, was then drawn up by the commissioners, and next Tluesday Shea will be on the "coppit" telling why he did the things complained about or whether he did them at all. 'lhe arrest was mlade by Deputy Sherifl l'elletier. The man who coiplai.ied against Mrs. Gallagher anl charged her with insanity is L. C. Thompson. lie claimed to he a friend of hers and her husband when he was securing the conl 'llint. But Mrs. Gallagher declares that her arrest was promplted by malice borne against her by her neighbors. She says that she did not move in the same social circles as her neighblors, hence she could not afford to inminltain an acqluainltance with them. She did not bear them any ill will, but her station was different; that was all. They foolishly resented her attitude, she said, and tried to be unpleasant, but she ignored them with that regard f-r her own self-respect that was proper to a lady in the circumstances. Say She Swears at Them. The neighbors declared that she swore at them and heaped opprobious epithets upon their heads, and that living in the vicinity of her house became a tax upon their endurance. At the trial the truth of the conflicting statements may be brought out. When Mrs. Gallagher reached the court house last night after her arrest, she pro tested very vigorously against being con fined in the jail. The under sheriff and all the deputy sheriffs exhausted all their eloquence trying to persuade her that it was necessary and unavoidable and also not such a bad experience, after all, but some force had to be used finally to get her in the jail. Bank, the money lender; Mrs. Campana, a liquor store proprietress, and John Gootch, a datryman, were all in an excited frame of mind this morning at the county attorney's office, and it was all about the doings of a lady named Mrs. Sarah Mcllenry, who tried to take the train for Salt lake at r o'clock this morning and leave themn in a very tan gled condition, as to certain money anod property rights. Mrs. McHenry was cooling her ardor for travel in the jail down stairs while t:rh trio mentioned discussed their surprise arid disappointment at linding her quite dilferent from what they thought she was before she undertook to leave the country without bidding them goal-bye. hLt,: .lcllenry was in jail on a charge of having !',id mortgaged prolperty, having been arrested by Policeman Sullivan at (;ootch's r:quest, at the ()regon Short L.ine Iailtoad depot in the wee, sml' hours, just as a hackman with a big cost that shielded her bird cage from view was assisting her to mount a l'ullman plat forr,. Gootch on the Scent. (;ootch trailed her like an Indian to the train, and ha volubly congratulated himself on hi; prowess, while he and Bank and Mrs. C'ampara talked about Mrs. McHenry's alleged delinquencies. Judge Vines, representing tlrs. Campana, who claimed to be out $45 as a purchaser of part of the mortgaged property in the meantime. was trying to find the statute authorizing Mrs. McHenry's arrest, while Deputy County Attorney L.ynch expressed the opinion that such a law did not ex ist. According to the story related about Mrs. McHenry, the lady, some time in the past, mortgaged a horse, buggy, har ness, cow and calf to Bank for $zoo. VWithin a few days past she sold the horse, buggy and harness to Mrs. Cam pana for $45 and the cow and calf to Gootch for $30. Yesterday Gootch learned about the mortgage and also that Mrs. McHenry planned to leave for Salt Lake on the early morning train today. Gootch stayed up all night and hunted for Mrs. McHenry, and he found her at the railroad station at a o'clock, about' to d.oart the country and leave him and Mrs. Campana and the money lender to adjust their troubles as best they might. Gootch said that the hackman spread his great coat so as to hide Mrs. Mc Hlenry's bird cage from sight, and that the lady left the hack in which she rode to the station, in a hurry and tried to board the train without being observed. Gootch's lynx-like eyes detected her, how ever. and he was so indignant at the act of the hackman that he gave him a swat on the jaw and knocked him down. Then the policeman accommodatingly arrested Mrs. Mcltenry at Gootch's or der and brought her to the courtly jail. After that Gootch hurried to the deputy. county attorney's room at an unearthly hour in the morning and aroused him in order to relate the trouble. After the injured people had talked the matter over, Judge Wines visited Mrs. McHlenry in the jail and effected a com promise with her and she was released.
