It has been the regular custom of cx-Kecorder Kaapp and other Recorders to deny trials by jury in these town cases for the simple reason that should that course be made the precedent, every drunksn bum who is pick ed up about town would demand a jury trial and the town would very shortly be bankrupt und our laws paralyzed. And every such person could demand and should have a "jury trial" recording to the orgau's argument In Mr. McGinn's case he has tLe right of appeal to the District Court when lie would get a jury trial if he should demand it. It is a veiy unusu.il ard exceptional case where a trial by jury is given in a police court f-.r the simple rea son that it is impiucticuble and where demand is made for jurj tri il in such courts the cases are trans ferred to ether courts or other de partments.
