Garoecho, of St. Ixuis, in a letter to the iSL Louis lie publican, given positive evideuce that the judgment of the United Staiee Su preme Court has been made up against the constitutionality of the test oath. (Jaresche, having been one of the suitors, was intimately acquainted with the proceedings, lie says when the Garland case was nrgued, the court divided on iL For the oath were, Chief Justice Chase, and Justice Davis, of Illinois, Swayne, of Ohio, aud Miller, of Iowa. Against it were, Justices Wayne, of Georgia, Grier, of Pennsylvania, Clifford, of Maine, ana r ieia, of California. Absent, Jus tice Nelson, of New York, and vacant, the seat of the late Justice Catron. Some time then elapsed, in the hope that CongieRs would repeal the oath; and it must, no doubt, still be remem bered by yoir readers that Thad. Ste vens, in the House, moved to that elled, and that he was said to have dono no at the instance of a largo number of 1'iack Republicans who had met at Mr. Chase s house, and because there told of the decision at which the court had arrived, or there could be no doubt what would be the final result, with such a jurist as Judge Nelson holding the casting vole. In its answer to these last motions the. court used the follow ing significant ltnguag: That when at the outset of the term the motions had been overruled, it was in the expecta tion that the (Mate would have moved in the matter, llut as there seemed to be now no expectation that that hope would be realized, it was riyht that the causes should be decided, and hence Hie motion to et them for the '.Uh of March was tusimned. Those familiar with the actiou of the Supreme Court will appreciate the force of this lan guage, lor it is never anxious to upset the action of State or Congress, unless duty required it. Such language was Utterly useless if the court intended to sustain the odious oath. I have not alluded to wiy vu n knowldge of what the decision will be.
