TIfl1 CLAIM OP 1t11 LEIkI4 UCOMPAYI, Touching the levee bill referred to In our yesterday's edition, we omitted to notice a feature of the law creating this corporation, which will serve to illus irate Its utter violation of the funda ttental law regulating corporations and individuals, and ought to admonish our legislators of their duty and the policy of getting rid of all such, Now, aecording to outr ivil Code, all corporations are juridicnl persons who are subject to the same conditlons and liabillties as other peresons, It Is is I possible to create a corporation which can be exempted from this liability of all persons under our constitutional and municipal laws, Bt1t this company sets up a claim by virtue, of some jugg'lng amendmentI of its corporation, to be exempt from all liability for damages to persons who may be injured by its note or ormis s ions, Thus the city of New Orleans and all railroad companies are fre quently held liable for damages done to individuals by their malfeasance or tisfeasance. But the Levee Company, a which undertakes to build the levees, to protect the property of eiltiens from damage by overflows or crevases, claims that It sl relieved and released from all such responslbilltlis by virtue of a certain act of the Legislature. Many years ago tohn MloDonogh was adjudged, to pay in damages twenty thousand dollatrs for his neglect in keeping up his levees, by which his neighbors were damaged to a large extent. But under the amend. ments of the charter of the Levee Com pany that corporation is exempted from all such liability. This, too, when this corporation is authorised to collect from the State and people a large annual sum, which is etpended in constructing levees at double the prices paid by private Individuals for like work, Now, if the Btate Is to hand over this large accrued indebtedness to the Levee Company, we think that justle and equity demand that persons who have been damaged by their failure to per form the work undertaken by them, should be recognized as entitled to a share of such sum proportioned to their loss and damage. These corporations, which bhave been trading so largely in franchsles be stowed by the otate, must be held to a strlct accountability, both to the State and the people, for all damage caused by them, as well as for i strict com. pliance with all the conditions of the grants to them, One of the greatest evils, the most frightful source of ep pression and Impoverishment of this people, has been in the reckless and improvident grant of franchises to stock-jobbing corporations, under the guise or pretext of promoting some great public object and relleving the people of some burden, or assisting in some great public work.
