Nominations were read as follows: Messrs. Jonas, Gibson and W yly. Mr. Wheeler withdrew the name of the Hon W. O. Wyly, Mr. Kennedy of the House nominated the Hon. Hugh Kennedy of Orleans. JONAS, Chairman, Mr. Lyons presented the following minority report: I reluctantly dissent from the favorable re port of the majority of the Judiciary Committee on the joint resolution appropriating nineteen hundred and twenty dollars. by way of ex tra compensation for the regular session, to the chairman of the Committees on Enrollment and Contingent Expenses of the two houses of the General Assembly. I think the resolution violates article 39 of the conrtitutlon, whi,"h pro iibits any alteration of compensation to members of the General As sembly, to take effect during the time of the House of Representatives, by whi'h such alter ation shall have been made. This article is equally prohibitive of an increase ot compensa tion to four members, as it is of an increase to a greater number, for if increased compensa tion can be constitutionally made to any one ember, increased compensation to any amount can be constitutionally made to any member, or to all of the members. The labors of these heads of committees are only incidental of the r membership of the Gen eral Assembly; and the duties imposed by these positions of honor, and trust, are only a portion of their duties as legislators. A I i:it compen sation is paid by the State for the whole of the time, and the whole of the services of each and every member of the General Aseembly.and any device by which a double reward shall be bestow ed is an evasion of a constitutional Iprohibition, and a violation of an fmplied contract. I have failed to find any written precedents for the vicious practi ae of distinguishing certain mem bers of the General Assembly by double com pensation, except such as may be found in the legislation of the past eight years and then in sueh proximity to. and so commingled with the most, flagrant and flagitious schemes for pub lic plunder; that the gravest suspicions of their lealtimacy and honesty are necessarily aroused. To say the least I think it unwise to follow in the footsteps of those who have brought the State to ruin, the people to bergary, and the name of legislator into just reproach and con tempt. I therefore recommend that the joint resolution do not pass. T. B. Judging of the frture by the past, I believe that I would be justified in concluding that while the tax is levied to support the levees, in fact and in truth it goes to the support of the Louisiana Levee Company. I have voted against this bill upon the motion to adopt it on its second reading and on the va rious motions to suspend the rules, because it embodied this principle. BScrwow 1. lie it enacted by the Senate and House of I epresertatives of the Sdate of Loucsiana in ,General Assembly convened, That in all criminal proceedings and trials before jus tices of the peace, in District and Parish Courts of this State, the parish of Orleans excepted the clerks, sheriffs and justices of the peace and constables shall not collect or receive irom their r soective parishes any fees or compensation for their services in excess of the limitations and amounts fixed in tbis act. eEC. 2 le it further enacted, etc., That in compensation for all services rendered in crimi nal proceedings and trials before justices of paace and in District and Parish Court,, where the costs and fees are chargeable to th + respec tive parishes, the fees of clerks of the court, sheriff., constab'es and justices of the peace, thron,honut the State, the pariah of Orleans ex cepted, are hereby F'm ted and fixed at fifty per centum of the fees and costs as are now paid by existing law, and the parochial authorities are hereby prohibited from increasing the fees and costs in criminal proceedings as now fixed by law. tEo. 3. Be it further enacted, etc., That this act shall in no manner affect the right of these oicers to charge and collect all fees as now fixed by existing laws, from defendants in all criminal proceedings and trials where the defend ants are decreed to pay the same under judg ment or sentence of the court, nor shall this act affect the right of the sheriffs to charge and collect, from their respective parishes, the fees and expenses as now fixed by law for carrying prisoners to the Penitentiary; nor for executing risoners condemned to capital punishment, nor fot inding and maintaining prisoners in the parish jails and costs and actual expenses in curred in pursuing and arresting criminals. c 4. Be it further enacted, etc, That in preiminary criminal trials for commitment wit nesses shall not be allowed any fees, per diem or mileage; that no witness fees shll be allowed for attendance before Grand Jurie, and in no criminal triýl or proceedings shall witnesses living wi hin five miles of the corthouse or place where the court is held be entitld to fees of mileage and per diem 8ac. 5. Be it further enacted, etc., That all oficers making charges for fees and costs against the parish shall still be required to present specific and itemized amounts duly approved under existing laws.
