A HIGH OLD'OOUBT. 11 Friday's Damoor~T we paid a well inlted tribute to the ability, industry and Ash moral Worth of the present Supreme Court of Lisolsana. This morning we pro pose, by way of contrast, to give a brief descripton of the organization of another Supreme Court, equal in nominal dignity to our Supreme Tribunal, but rather different in its personnel and manner of conducting jdicial business. Perhaps some of our oldest bitants will remember the incident weare about to relate. When, in the year 1810, the inhabitants of that portion of Louisiana now known as the Florida parishes revolted against and over -threw the rule of Spain, a provisional govern ment was organized, aad, as a matter of course, that government included a supreme judicial tribunal. Lawyers were not quite so plenty then as they are now, so the appoint ing power selected and commissioned as judges of the high court referred to three prominent men, neither of whom probably had any particular knowledge of jurispru deance, namely, Fulesden Sklpwlth, Captain Percy and a Mr. Mather. Skipwith, a Virginian by birth and educa tion, had been UTited States consuI in France and was a stickler for precedents and similar t&44s of action. Percy was an Englishman, had been an ofileer in the Royal Navy, and bore about himself through life a touch of quar terdeck manners and habits. Of Mather noth lag is known beyond the reported fact that he was of a somewhat irritable temperament and had a relish for "jugged gin," a Dutch drink then in vogue and which was put up and sold in small stoneware jugs and bottles. When the court was about to be organized Mr. Skipwith, whose reverence for forms we have mentioned, was sorely perplexed as to the ,proper modues procedendi, because of the fact that neither of the three judges had been designated as Chief Justice. Not so, however, the bold mariner, Capt. Percy. "Aw," said he, "I can soon settle that trouble. Mr. Skip with, you take that seat, sir, if you please," and he pointed to a chair on his right. "Mr. Mather, you take this one," and the Captain indicated a chair on his left. Then, seating himself between the two, "I am the Chief Justice," he exclaimed, with cool aplomb, and no he remained. t110e nor5IaUmU. One of the first cases of which this court took cognizance was that of a man accused of having stolen' a horse. One version of the affair is that the offense was charged to have been committed in Georgia, but that was probably a fiction, invented for embellish ment. The accused begged the court to name a lawyer for his defense, pleading pecuniary inability to employ one himself. "Never mind athat a lawyer," said the Chief Justice; "you shall have a fair trial, sir, and if innocent will be acquitted; but if you are found guilty, as Ithlnk you are, damn me if any law quibble is going to let you slip through my flingers." What the Issue of the trial wAs we have for gotten, but the tradition that Asaociate Justice Mather, in addressing the prisoner, aecosted him as "Mr. Damned Rascal," would seem to justify the assumption that it was a convic tion of the accused. The New Orleans Pacific Railway, now in its vigorous youth, cannot go forward without the power of money. The hfnds heretofore contributed have beef well applied, but its cash resources are almost exhausted, and it needs pres ent help. The people of New Orleans desire and intend to have this road, and all they want is confidence that it will be built. The trouble is, that what is every body's business is nobody's, and thq community, while intending to help, still leave it to somebody else. Now, as one mode of securing the gen eral co-operation of the public in this enterprise, the undersigned friends of the road have now open, for a few days, an office on the ground floor at No. 27 Camp street, where every inhabitant of this cily Is earnestly invited to call and interchange views, and to define what he will-do. This is intended to be the voluntary action of the people, independent of any other effort which may be made. Every facility for imparting informa tion will be extended, and the presence of as many of the friends of the road as possible is solicited, th aid by their presence, their counsel and their means.
