All bakers or other persons using or carrying on the trade or business of a baker as aforesaid, shall make or cause to be made all their loaf bread of good and wholesome flour, and they shall give it the weight which may be fixed by virtue of the present ordinance relative thereto by the Common Council; and further, all bakers or persons using or carrying on the trade or business of a baker, shall only be allowed to sell, or expose for sal-, loaves of bread of the value of two dimes, one dime, or half dime. 8Ha. 3. Bakers, tavern keepers and other per sons selling breed, or offering the same for sale, are requuied to have the weights and scales duly regulated by the standards, and the inspectors of weights and mesoures are authorised to proceed to try them agreeably to the law respecting weights and measures. Hac. 4. It shall be the duty of the oommissa ries of the markets and the pollee officers at least once in each week to inspect and examine within the several wards or distriolt of this city, and the public markets, all loaf breoad baked by or for or on account of any baker or bakers, in order to a certain whether the same is made of the qual ity of flour required by the present ordinance, and to ascertain whether the weight thereof con forgts to the established asize; and to that end the said commiesaries and police officere are hereby authorized and required, at any time between sunrise and sunset, to enter any bakery, bakehbouse or shop, or any other build. ing or enlosure wherein loaf bread is or may be baked, stored, deposited or kept: as a'eo any tavern, shop, store or any other place, wherein loaf bread is teposi ed, stored or kept for sale. And it shall further be the duty ofthe commissaries of the markets and police offioers tosto and detain all bakers, or other persons, carrying bread for sale in baskets, carts, wagons, or otherwise, through the public streets or high wayr, and examine and weigh such bread; and upon such examination, should they findt snbch bread, in whole or in part, unwhole. some or wanting in weight, or not bak, d agreeaby to the present ordinance, he shall conduct the offtnder or offenders before one of the recorders of this city, who, upon due proof made, shall pronounce the seiz ure and confiscation of such bread for the use of the orphan asylums of the city, and shall further aondemn the otfender or oflenders to pay a fine of not less than twenty-five dollars, nor more than fifty dollars, and in default of payment thereof such offender or offend rs shall be im prisoned not exceeding thirty dave. Any oflicer, oommissary or police officoer neplecting or refus ing to enforce the foreooing shall be dismissed from office. 8tvo. 5. The Mayor shall publish in the ofitcial journal of this city every Baturday an assize of bread for the ensu ng week; to this effect he shall estimate a barrel of flour to produce three thousand seven hundred and thirty-two ounces of breal (American weight), and in order to as certain the weight of the five cent loaf the num ber of ounces shall be divided by a number equal to the number of five cents a barrel of flour may be worth in the market at the time of fixing the -aesire, and adding the five dollars or one hundred five cents allow0d to a baker by the law, the quotient shall be the number of ounces a five cent loaf shall weigh. That of the first quality, commonly known as "Fancy Bread," shall not come within the provisions of this ordinance so far as regards the price and weight, and shall not be aff cted or control ed by the foregoing assize; provided, that such bread shall not exceed one 'pound in weight, and shall in all other respects be made and baked as herein required, and all bakers or other persons making, baking or selling such bread, shall in all other respects conform to and co:mply with the provisions of this ordinance, under the penalties therein fixed. Bread of the first quality shall be stamped with the figure 1, that of the second with the figure 2, and that of the third with the figure 8. Anyi baker not complying with tho provisions hereof, shall, on conviction before any of the recorders of this city, be fined not less than twenty-five dollars nor more than one hundred dollars. 6xt. 8.
