Mr. Brown oalled up the following ordinance, which having been read twice wasee now'bn its third reading, and it passed unanimously, the yeas and nays having been called: "An ordinance provid ng for the payment of the several asocounts therein named," beginning "D. 1. Penn, Register of Conveyanoes," and amounting to i6853 44. Reports of enmmittees. Mr. Edwards reported that bide were received for repairing the Supreme Court room from 0. Beenard & Montagnet for $3386, and John Page $1000. The latter being the lowest it was recommend ed for acceptance. Mr. OCaInan reported favorably by resolutions on the petitions of (1) (. tragnard, for permie slon to erect a stla n engine at No. 78 Decatur street; (1) Stewart & Wise, for permission to erect a steam engine at No. 911 Front street. Mr. Edwards reported favorably by resolution on the petition of the Board of Oommiesioners Firemen's Charitable Association, Seventh Die Miot, for the erection of an alarm bell and tower. Mr. Dents reported favorably on the petition of Mrs. Mary Todd for the ancellation of a tax bill, recommending that said tax bill be canceled. Report adopted unanimously. Plebury, Mlayol: Si,'-According to the charter granted by the Loegielatur of Lnºeiana. in its session of 1830, approved January 20, 183., to the Pontchartrain Railroad Company for the privilege of construot ing and maintaining a railroad through Elysian Fields street, from the river to the lake, the com pany had to provide all necessary arrange monts at all intersections in order not to impede the free pussage of vehicles. etc. By an set passed on the 234 of February, 1830 before Felix de Armu, notary publio, tiernard Marigny sold to Martin Duraide, President of the Pontchartrain Railroad Company, all his rights (with no guarantee) into that portion of ground forming the centre of hlystan Fields street, and known as Marigny's canal, measuaring in Amorti can measure 53 feet 3 inches 4 lmes in width, ex teudirg in depth from the river to the rear limit of his property: also, the canal leading from E.lysian Fields to Bayou St. John. By resolution of the Council of the city of New Orleans, aproved March 15, 1830, the privilege was grantea to the Pontchartrain Railroad Com pany to occupy the eastern sidewalk bordering the 53 feet 3 inches 4 lines sold by B. Marigny, during the existence of their charter--forty years; but in granting said privilege, the ordinanoe etipulated very plainly that the company should in no manner impede circulation of the public in the crossings of streete. Some twenty years ago all the croesinge of that atrp of land in the centre of Elysian Fields street, from the Levee to Goodoehldren street, and later, those fiom Goodch:ldren to Claib irne street, were made with curb and gutter stones and brick sidewalks, one-third the cost of which and the whole cost of intersections were paid by the city. During the period of about forty years Elysian Fields street was occbuird on'y by the Pontchar train Railroad, but ab ut seven years ago the New Orleans and Modile Railroad constructed ,their track on the eastern sidewalk belonging to the public, upon which the Pomnthartrain 14 il. roa3 had constructed theirs, with the permission of the Couscil, for the t rm of their contract, which permission had just expired and not re newed. Up to the present the intersections were kept in tolerably good condition, but lately the Pontchartrain Railrod has constructed two new tracks from Victory to Dauphine street, and one from Danphine to some point beyond Clai borne street, and by so doing hue entirely de stroved all the intersections by raising their tracks above the level of the sidewalks, tune cre ating between the two tracks a hollow, which in . rainy weather is impasesale. The plankixu between the raile hovers only four Sor five feet of the sidewalk, while it ought to cover ten feet, the sidewalks being ten feet in width. In many places rough round paving tones have been put m place of bri k worx. For some days past some one had been erecting o the centre of Elysian Fields street, near Dat tinre eet. an octagon frame buiding, shout 60 feet ino diameter, in which I suppose will be pta citern, forming a great obstruo;ion to the I il . r -marlk that Mr. Margny, in eelling the r, Aunburb Marlgny, New Suburb Marigny and Sub urb Franklin, only reserved the stripe of land in the centre of lElyes~n Fielde street for the pur pose of making a navigation canal; that he onlll sold his right to said canal, which saccording to an ordinance, the date of which I have not at present, wag transferred from a cenal to a rail. road privilege. Consequently, they have no right to build on said strip of land without permission of the City Council. Respectrully submitted. J. . D'HI MEOOURT, City Surveyor. On motion the report was referred to the proper city officials with Instructions to notify the preel dent or receiver of the railroad company to com ply with the laws and ordinances at once, and in oase of refusal or neglect to proceed legally against the company. Mr. MoCaffrey stated that bids were received and opened for the repair of the different nui sanoe wharves, but a protest was handed in by the citizens of the Ninth Ward against the pres ent location of the nuisance wharf in said ward, which prevented him from reporting at present. Any privy hereafter constructed shall be not to exceed two feet below the sutface of the ground, and be walled with brick or atone, laid in c-ment with sharp sand, its whole depth, with water-tight bottom, snd said wall shall be raised at least one foot above the surface of the ground, anl shall be so constrtcted as not to have any issue or opening on any street, way, yard or place; nor shall it be within three feet of any street or way, and shall be built adjacent to any wall, whether a party wall or otherwise, be separated therefrom by solid masonry of not less than two feet in thickness, laid in cement, and thoroughly water-proof; and shall have a flue or ventilator sufficient for ventilation, extending above the surroundiug windows or communi eating with a chimney. Any peisou building or causing any privy to be built in contravention to this section, or any part of it, shall be liable to a fine not to exceed twenty dollars. And the court before which suit may be brought for violation of this s-ction, or any part of it, shall, in rendering its judgment, order such privy to be reconstructed in accordance with the provisions of this section, within a reasonable time, and in default of such compliance with such order, the party so failing to comply shall be sub. jected to hke penaity and punished as in the first instance; and the board of Health may cause such order to be complied with at the expense of the person ordered as aforesaid, said expense to be recovered in any court of compeoent jurisdio . tion at the sutt of said board. nvc. 2. Whenever any privy vault shall be filled within one fiot of the surface, or whenever the Board of Health, through its proper officers, shall so order, such privy shall be emptied by the owner, agent or tenant of the premises, within forty-eight hours, under a penalty not exceeding twenty-five dollars. SEc 8. The emptying of privy vaults shall be made between the hours of 5 a. m. and 8 p. m. At least twenty-four hours previous to such emptying, the contents of the vault shall be thoroughly deodorized by means of copperas and carbolic acid, or other agents, as directed by the Board of Health, and immediately afterwards the vault shall be again deodorize.i with lime and carbolic a.,d. Any vidangour violating this sec tion, or any part thereof, shall be liable to a pen alty not exceeding twenty-five dollars for each and every ffonse. BEc. 4. No privy shall be emptied of its con tents otherwise than by some odorless apparatus, approved by the Boarl of Health and the City Ctouncil, and the solid matter shall be placed in air-tight barrels, under a tent, with the aid of such disinfecting measures as may be approved by the Board of Health. Any vidangeur vi.lat ing any provision of this section shall be liable to a penalty not exceeding twenty-five dollars. &Ec. 5. No privy shall be emotied without an order or permit from the Board of Health, di rected to the owner, agent or tenant of the premises, under a penalty not exceeding twenty five dollars f.r each and every offnase. 8EC. 6. Whenever, in the opinion of the proper officer or offierr of the Board of Health of the State of Louisiana, any privy or privy vault shall he in a condition such as to require the same to be deodorized or disinfected, be or they shall cause notice thereof to be aiven to the owner or tenait of the premises, where such pnvv or privy vault may be, to deodorize or disinfect such privy or privy vault within a delay of thirty-six hoors; and for any retfual cr neglect to obey such notice, within said time, such iffender shall be liable to a fine not exceeding the sum of ten dol'ars. 8Ec. 7. No person or persons engaged in the cleaning and remov ng from privies, vaults, etc., of !fcal matters, shall dispoce of or dump the '0 same except from the nuisance whrvt esetab lished at the head of ; pro vided, that parties engaged in the manufacture of commerotal fertillasrs may receive and use such fitoal matters by special permit and under the regulations presrtibed by the Board of Health.
