In the matter of dispute between Judge Smith and the Attorney General, as to the duty of the latter to appear on hearings of State cases before him, we will not presume to give an opinion on the legal aspects of the question. But of the great importance of the State be -ng represented in all such hearings ex perience has given us a very decided -onviction. It is the practice in all the -other States. The judge cannot stand for a prosecutor, and ought not to be required or expected so to appear and ;act. Nor is it prudent or proper that pri vate individuals representing private in :terests should control such prosecutions. There is always two much danger of a ,eompounding or compromising of the State's interest in such prosecutions from the appearance of private parties by private counsel. Nor should there be an opportunity for private parties to gratify private malice or revenge in the in the name of the State. The bearing nnd conduct of prosecutions before com mnitting magistrates is the first and most important step in such prosecutions and the State ought always to be repre sented therein. The hearing of Fulton's case has been postponed without a day. This, on ac count of the absence of counsel. Such postponement on the grounds stated do not appear to us to be in the spirit and practice of the law, which requires a speedy hearing of all such cases. The accused ought to be ready, at least, to submit his defense, and the Stat9 her probable cause, after so long a delay 'since the arrest. There are many dangers which such a postpone ment exposes .a prosecution to. The lack of vigor and promptitude in our criminal prosecutions has given reat immunity to crime in Louisiana. nease like that of Fulton might long pinee have been pushed to a hearing.
