The minutes of the previous meeting were ap proved and their reading was dispensed with. gam uneatelttons from the Mayer and Admltinntrator. Tothe CityC Connoil of New Orleans: Gentlemen-It becomes my duty to report that an examination of the wharves lately rebuilt by the lessees in the several districts show that the same have not bewn construeted in asoordanoe with the spealsationas. The piles are not driven to the proper depth and at a greater distanee apart than ten feet from osntres, some being as mueh a fourteen feet. The lessees also neglected to fasten the string ers at each cap with a rag-bolt. These omissions were not tathorfisd by me and will tend to great ly impair the durability and usefulness of the wharvee and render them liable to yield at any timoe to the weight of freight ordinarily placed theeon by vessels receiving or unloading cargo. I recommend that immedlate teps be n to place a foodgate in People's Avenue Canal at -attllty Bidge, In order to protect that portion of the city from overflow. During northeasterly wnads the Gulf banok the water through the sanal and overflows its banks, oausing much damage to property and greet injury to the resi dents in the nesighborhood. This floodgate will be necessary when the catal is completed to ayoua lenennu, and should be construcneted now togive proper reliesf. The contractor for repairing the plank roads has commened work and already completed J.lla street. I recommend that the old planks Ntket om the streets under contract be used in the r of other roads. Complaints have been several times received from resideate alon the line of said oad. The nuisance wharves of the various distriete are n a very dilapidated condition and need im mediate attention. A new wharf is needed in the Fifth Distriot (AlgIers) and one in the Third Dis. riot. This canal is filled up to the level of the street gutte's, and every rain causes an overflow of theneighborhood. Accompanying this report I submit a resolution providing for the cleaning of same. Charles ravanac, Administrator of Com merce: Dear Sr--I have the honor to answer your communication of yesterday, relating to the wharves of the Third Distriot, as follows, to wit: 1. The lessee of the wharves is not building and repairing the wharves of the Third Distriot arnaomr. in aooordance with speclfloations of his contract the piles being at greater distances and no braces being placed ; in all other points they are in accoordance with the contract. 9. The lessee has, in my opinion, a suffioient foree at work to put said wharves in time in a condition to eatiery all the wants of commeroe, and the wharves already built are of more than sufficient strength and size to recelve and support all the freight to be deposited uoon them. . The lessee is sing sound and good mate salin bliding and reparing the wharve and landinge of the Third Distrifet, and the wharves aready built and now being built are as I have heretofore stated, of sumoient elso and strength toaccommodate all the wants of oommeroe, and should they be built ten times stronger they willrave at the next low water of the river, and will oontinue so to do yearly, until some plan oan be devised by which the oaving of the bank can be forever stopped. In conclusion, I would state that the inhabi tant of this distriot have had just apprehen alone that the whnerves would not be built in time to meet thenecessttelee of commeroe. The lessee at that time a engaged repairing the wharves "o the upper dlstrict, where the stationary banks will allow work to be made at any stage of the water. On or about the beginning of last August a commlttee composed of his honor, the MIaor, Ad s.inistrator Mouafi.y, yourself and myself made a thorough examination of this district and found the river banks, as well as the wharves, were atving in the mot dreadful manner. Work was begun abount the twentieth of August, even too soon, as several batteree caved in after the com mneneement of the work. The extent of the work to be done together with the very short epaoe of time allowed me from the time work could be begun, to the sup poed arrival of vessele, the 15th of October, led me to make those wharves as they are built, to meet in time the wants of commeroe. Gastinel, for payment of five months' salary as attorney for Metropoli an Policoe Board, from Nov. 1,1876, to March 1, 1877, reported favorably for $60, being for salary fom the ist to 8th of January, the date of aboiid tim of the office of attorney. The salary due pretoous to January 1, for the mouths of ;Iyoelu* ii·bc bet and December, 1876, the petitioner is entitled to be paid from the police tax levied for said year, when colleoted, but has no other claim on the city.' Adopted. 2. On the petition in behalf of the parish of Jefle'son for rent of court-house, Mr. Brown re ported favorably; rent $50 per month, to com mence January 1, 1878, and to continue so long as the city of New Orleans may require the use of said building for the purpose of holding court, under act 45 of 1876. Adopted. By Messrs. Denis and Brown Reported favorably on petition of F. Diebel for 868 50, being amount of judgment and costs paid by petitioner, as shown by record of court and bills. Adopted. Ordinances san Lesoltleons Offered. By Mr. Oavanao 1. Resolution granting Hon. John E. King per mission to transfer and change the location of several small buildings on the levee, and to erect a floating boathouse at the head of Hospital street. Adopted unanimously on a call of the yeas and nays. 2. Besolution granting M. Hermann permission to remove his steam engine from No. 80 Osamp street to No. 89 Canal street. Adopted. Whereas, The people of New Orleans feel a deep interest in the imortance of the early con struction of the New Orleans Pacific Railway, to conneot this city with Shreveport, [Lousiana, and Marshall, Texas; therefore be it Resolved, that we, the kayor and Administra tors of the city of New Orleans, do hereby cor dially recommend that the Representatives of the State of Louisianr in the Congress of the United States, at Waehinton, do earneatly support and aid the paage of the Tease and Paciofio Railway bill, provided the New Orleans Placflo Railway, which has been in continuous course of construc tion by the means of our own people for a period of over two years, and having the confidence of the community, as the road entitled to govern mental aid, be embraced in said Texas and Pa. oid bill, as the New Orleans branch of the Texas and Pacifio Railway. Besoied further, That the Mayor be and is hereby requested to send copies of this resola tion to our Representatives at Washington. Adopted unanimously. By Mr. Diamond, and passed unanimously, the yeas and nays having been called Resolved, That article 18 of ordinance No. 8198, approved December 80, 1851, be amended and read as follows: Every person violating any proviston of this ordinance shall be fined not lees than $2, or imprisonment for thirty days, or both penalties, at the discretion of the court. . Mr. MoCaflrey offered the following resolution to reimburse said company, which was unani nously adopted: Resolved, That the sum of $125 be and fis here by appropriated to reimburse the Louisiana Field trtilery for expenses toincurred in firing salutes n the 4th of July and 14th of Beptember, 1877, md that the Administrator of Publiho Accounts rarrant in payment of the same. [No. 4119-Administration Series.] Resolved, That the City Attorney, B. F. Jonas, be and is hereby requested to furnish for the guidanoe of the Counoil an opinion upon the fol lowing points connected with the 8sugar Shed question: 1. Whether, under the law, the Council has the right to declare of its own motion the forfeiture of the privileges granted under ordinanoe 1528 N. 8., for exacting illegal and excessive rates of storage. 2. And in the event that the City Attorney be of the opinion that the Council is so empowered, whether said buildings on said forfeiture revert to the city as in case of expiration of charter. 8. Whether, if in this last event, the city will become responsible to the Sugar Shed Company in damages or in any way for the value or any portion of the cost of said buildings. 4. As to whether there exists any practicable means of forcing the Sugar Shed Company to re duce its storage rates to the charter charges by ordinance, or whether legal proceedings in the courts be necessary to that effect. 5. Whether, in the event of a determination of the Council to forfeit the charter, judicial pro ceedmgs will be necessary; and if so, what facte must be substantiated in order to procure a de cree of forfeiture. 6, In case of esuh a Judicial decree of forfeiture, whether mobh a udgment can make the city re sonaeible in damages or for the cost or value of the improvements, in case a reversion of the buildings to the oity be decreed. 7. That Mr. Jonas, the City Attorney be re quested to advise the Counoil whether the facts alleged against the auigr Shed Company, or any of the saot of said company, have been violative of its charter and are such as would entitle the try to obtain a forfeiture. Therefore, Resolved fuirther, That until the Ceuncil shall have received responses to the foregoing in quiries all action relating to the Sugar Shed Company be suspended.
