I consider it neoessary to notice only three of the points Presented by the solicitor for the ttate. I. Upon the first point the deoisien of the court Is that "so far as relates to the capital of the bantik, WhIch was to be represented by the bonds anti m'tgages of the stockholders, the 8itate and the nadhlolders are both pledgees, and either might atboroe, by any proper proceeding that pledge." As to the second point, the court over rules it also and decides that the appointment of reoeiv in iy the court was fully authorized. Upon the third point the court says: "IT, there ft, the service upon Irlanders was not a service upon the assooiation he being the last president, the suit would not at ale, nor would the validity of the appointment of a receiver be aeffcted hereby--lt would simply be the duty of the Iourt to allow the stockholders to be served. Let the motion on behalf of the State be, there f.re, over ruled. The court said that it was hetter to have a third receiver appointed, as differences might arits between two, and, therefore, to avdid com piloations, Lieut. Gov. L. A.
