It was taken up M motion of ?Senator Wright. A short debate oceurretl, in which tlie old arguments familiar to both sides were revived in I comptiet form. Tho notable featuru of the discus sioi) was Senator llayard's support of the veto and Senator Conkling's opposition to it. Mr. I'ayard ?aid. he thought .*}*>0,000 none too much for the Chief Executive. Mr. Conkling maintained that ?198,000 was proportionally as liberal a compensation for the President as $5,000 for a Senator. Tbe vote on passing the bill over the veto was. Yeas, 2."> ; Nays, 10, not two-thirds in favor, so it was lost. More Republicans followed Mr. Conkling's leadthan I), in oerat? Mr. Bayard's ; but tho vote had little if any political signifi.-anre. I Washington, Dec. 18.?Mr. Morton was in his seat ia the Senate to-day. He remained in Indianapolis only 18 hours. In reply to the inquiries of his friends, he says that his hasty trip was for the pur? pose of transie, ting some private business which re? quired bis personal attention. During the short time he was at home the Senator learned enough to satisfy him that the Democratic State Convention to be held at Indianapolis on Jan. 8 is intended as a menace. He believes that the leaders of the Indiana Democracy mean to serve no? tice on the country that they will not submit to any result of the election that does not involve the in? auguration of Gov. Tilden. Senator Morton heard from Republicans that secret societies have been organized in various parts of the State, whose mem? bers are pledged to resist by forte the authority of Hayes in case he is inaugurated. Of this he says he has no personal knowledge. Mr. Morton criticises ?severely the action of Gov. H.-uihricks. who is seeking apparently to inllam. the feelings of his party instead of counseling modera? tion and submission to the forms of law. The most excited class among the Democrats is composed of the small politicians, each of whom had made up his mind which Federal office he would take for his share of the spoils as soon ma the first news came that Gov. Tilden was elect??!. The Senator says that it is men of this sort that do the violent talking and are activo in organizing indignation meeting-. CONGRESS AND THE PRESIDENCY. WHY THE CASTING OUT OF ELECTORAL VOTES WOULD NOT SETTLE THE QUESTION?A DECISION NOT NECESSARILY KKf-KRRKD To THE Hot HK. (FROM A KKf.l LAB CORRESPONDENT OF THE T8IRCNK.1 Washington, Dec. 16.-Much of the discus-ion on the Presidential entanglement in and out of Con? gre? has proceeded upon the assumption that if the Senate would concede the riglitfulness of the claim of the Hou.se to reject the vote of any State, the whole question would be settled at once. This is an erroneous idea. Behiml the dispute?! point as to the power, joint or separate, of the two Houses over the counting of tho vote, there is another of etjual im? portance and equally involved in doubt. It is this : In case the vote of one or more States be nut counted, does the election go to the House of Rep? resentatives, or is tbe candidate having a ma? jority of tho remaining vote? elected f There aro no precedents throwing light upon this point, and the language of the Constitution, although affording moro warrant for tho latter conclusion than the former, is (ijvn to a double construction. It is evi? dent that in the present condition of party feeling, if the result o? the election should hang upon the decision of this question, each party would insist on the construction which would best subserve its own interests. The Democrats, desiring above all things to throw the election into the House, would maintain that nrt one could be President without receiving a majority of th<? total electoral vote, and that conse? quently there had been no election by the people. On the other hand, the Republicans, quoting the language of the Constitution, which says that "a majority of all the electors appointed" shall be aeceasary to a choice, would hold that tbe rejection ef the electoral votes of any State would imply that the electors giving them were fraudulently or un? lawfully appointed, and were, therefore, in efli ?t Hot appointed, and that consequently the candidate having a majority of all the votes accepted and counted was elected?the House having nothing further to do after the conclusion of the count. If the Republicans agree with the Democrats that each Mou?e has a right to reject the vote of a State, Un House would of courso throw out South Carolina, Florida and Louisiana?18 electoral votes it all.
