The certificate held by the correspondent is ??evidence of any obligation of the State unpaid by in financial officers. The law of 1859. to which ?ferenceU made, distinctly says in the eighth sec? tion that tbe certificate shall be paid: " Whenever wy moneys eball be received by this State- from the Government of the United Stales on the claims referred to." The United States Government bad always declined to make any such gift to the State of New-York. Although under no moral obligation to do so the State itself paid a large number of these tertificstes, expending $250,000 for the purpose Between 1859 and 1874. lu 1876 a bill was passed by the Legislature ruakiug a further appropriation toward the payment of the certificates. Governor Tilden vetoed tbe bill on the ground that it was un? constitutional under the amendments to the consti? tution adopted in 1875 to give a gratuity from tbe Bjooey of the State. The veto was approved by tbe Oest lawyers in the Legislatore.
