Tilden for the roust'ur'"'" of thc clauses In lb** will ?f bli uncle, Samuel J- Tilden, eo.ebtt*hlQ| thc Tilden Trust and pruvidlu** for fi-oo librarlee in Xow-Lcbanon Yonken and thu city, wore beard by J_->tice Law reit*** In thc 8uprcme Couri, special Term, yesteitlay Tte executors, who are thc defendants In the case? John Bigelow, Aadiww H. (.'roon and George W. Smith ?wen all present. Stephen A. Walker, ex-Judge Horace Russell aud Morris **, Miller were also there. Deles MoCurdy, Smith Weed and Lyman D. Brewster npreaented tbo plaintiff, and ex -surrogate Daniel G. Bolllm, James C. Carter, ex-Judge George T. Com? stock and Lewis Casa Letty ard appeared for tho de? fendant*. Mr. MeCurdy argued that the testator was a man of great ability, of clear mind and a master of lau gu ages, and himself prepared tho will, and what wat not clearly indicated as hts Intentions should not be carried out. The testator had three definite objects In view?to benefit mankind, to establish tbe trust and to execute charitable pui-pc-es, leaving the property to be thus used as the executor** deemed proper. CAN T?K TKI RT BK EXFCUT. D? The trust was so iudeflntte and uncertain that lt was Incapable of being executed. Cnless tho trust was to constituted that tho court could Indicate what the executors and trustees were required to do and how they were to carry out the objects of the teeta tor, lt must bo pronounced Invalid. The clause rested do Interest tn any specified perron, and as lt ?tandi, without tho aid of some extraordinary power, not possessed by tho Supremo Court, it would bo In? capable of execution. If the clauses of tho will tn question were to bo construed at giving property for charitable purposes, then lt must be borne In mind that no trust could bc upheld under tho laws of this State tor charitable purposes unless they were so spe? cifically tet forth that the court could not only clearly tee what those purposes were, but could also ascertain tbo amount of the trust property conveyed and tho beneficiaries under lt. There was nothing In tho will to Indicate tho amount of the property to lie used foi- the purposes nf tho trott. There was no specific direction that tho ex? ecutors thotild give anything In any prescribed direction. It simply authorized and permitted them to do certain things, but did not command th"m to do anything. Mr. Tilden did not declare, his Intention to vest the property In the Tilden Trust or In any trust, but vested tlie e**flr*e residuary "state In the executors and gave them power to dispose of lt. Tho provisions of these elaosm "f the will were con tnry lo the statute against perpetuities and did not lltr.lt the bequest to two lives In heine. The limita? tion as lo the trust was left entirely to the trustees. The provision* could not he upheld as an executor* devise or beqiiest tnd th" trust must hi* declared void at not sanctioned by any statute nf the state. MR. it.iti.ivs rri'oi tst thk tofU. E_-Stirrog*te Rollins said that the construction of the disputed clauses In the will was a manor requir? ing weighty consideration and of great Importance to the people for whose benefit Mr. Tilden had intended them. It Involved the disposition of pi-operty worth trom $4,000,000 to if5,000,000. and lt was to be de? cided whether Governor Tilden, who was an eminent lawyer and a man of g? at learning ind Intelligence, know what he was doing when he mado his will or had miserably failed In setting forth his Intentions. It waa to be decided whether this vast estate was to pats Into the hands of those for whom lt was not Intended or whether lt was to bo Se*0te_ to the use cf the public for all Hmo In accordanco with the de? sign of the testator. Mr. Tilden was an eminent citizen who had been called by his feiiowcltlzens to many position* of ere-it dignity and Importance. He hnd neeta counsel to tho corporation, a delegate to constitutional f<>r.ve*,tlons. a member of the legislature and Oorernor of th** **tato of New-York. Ile had a large fortune and he had mn-lo a liberal provision for bli n*phetrt and nieces. He was horn 1n this Slate and resided for the tarter part of his long lifo In this city. When he mado h's will he w.v r00Ol**Od to per? petuate h1? memory and lepefit his fellow-citizens by fhe endowment of a creal public ehirlty. Hy thc clauses of the win whleh vam bete lo be sonslrued It wat clear that he had declared In unqualified terms it* Intention to found such Institutions. He had other***!***, provided for Ms next of kin and had mado "provision* for them satisfactorily to himself anil lt was tho satisfaction of his Wishes that was hf*re to be r*..n Sloered. .Th" sneaker react fhe b**qn*"-is made for Mr. Tflden's next of Mn and declared that if his wishes were to be respected all the provisions of the will must bo carried out. A r.RKAT LIBRaRY FOR Tllf. CITY. Tho t?ttator had In mind In establishing the Tilden Trust the giving to this city of a larger library than was ever given to any community In the world. Ho had recognized the possible difficulty of having lils Intentions In this respect carried out and had. there? fore. Inserted the alternative clause In the will. Mr. Rollin* Insisted that the trust could be carried out. The testator's preferences wore clearly manifested. He directed that a charter should bo obtained for tho Tilden Trust and that lt should bear his name. Did this mean nothing? He would not contend that the alternative clause, jiving the trustees power to "?elect the charities le which the property might bo applied, wat good In lt*w nor would he concede that lt was bad. What he claimed wa* that the trust first spoken of as valid. In England and under tho laws of sixteen State* of this ooh nt ry lt would, beyond all doubt, be sustained. The law In this Rate, too, was clearly laid down and wss firmly established hy decisions of the Court of Appeals. Let ll be assumed, for the sake of argument, that the alternative clause was not worth the paper lt was wrlfScn on. What then! It was a well-established nile that where the Intentions of a testator were clear, as he claimed that they were In this ruse, they must l.e carried ont. Ex-Surrogate Hollins had not fln'shod his argument when the court adjourned to 10:1*0 a. m. to-day. TO END THEII*. MA lilli I.*.) LIFE BY CONSENT. Wednesday, March 21?p. m. The speculation in stocks was directed again by Missouri Pacific, which is supposed to repre? sent in a special degree the views and possibly the pecuniary interests of the present managu* mont of the Gould Southwestern system. A de? cline of about. 3 per cent in the prioe yesterday resulted in only a fractions*)! los*, to the general list, and for this reason perhaps a further break was nc_s_ry. It was noticeable, however, that Missouri Paciflo fluctuated within a rangs of 1-2 per cent until the last hour, and that then lt was selling at the opening price. The fall from 81 3-8 to 75 1-2 was rapid at times, but near the close the sales between 70 and 75 1 2 amountod to less than 1,000 shares. With the aid of a further decline of over '_ per cent iu Western Union, the effect was a general decline of about 1 per cent. It ought not to be overlooked that Manhattan closed 1 6-8 and Pacific Mail 2 per cent lower. The only other stock tbat fell heavily was New-Eng? land, which may bo more or less under Gould influence. The market was active Ht the decline, and for that reason the movement was cordially w_t comed by everybody. It is impossible to detect the purposes which underlie the recent decline, and probably the only cause is the proftvsssionul character of the siieculation. In the trading view, it ls of little consequence that the Bur? lington strike is virtually ended, that fresh labor troubles are nearly impossible, and that every day brings nearer thc favorable action of Con? gress on financial (questions. The constant pro? gress made by the English Parliament towara tho conversion of British funds is a fact that ought not tao be overlooked by American investors or speculators. It is only less important than the possible action of Congress. The influence is 6ren in the European demind for first-class se? curities, a demand that already has delayed tho usual spring exports of gold until there is a rea? sonable doubt whether large shipments will be made. The course of prices to-day seemed to in? dicate that the general market will break I0060 from the stocks that at present control it. Tho closing was slightly abovo the lowest figures. WHAT WAS DONE IN BONDS. Government bonds were unusually active, without concessions in prices. There was a fair demand at the offices of the principal dealers. There were no transactions in State bonds, and the only sale of city bank stocks was of Fourth National ll5) at 135. Railroad bonds moved in sympathy with tho speculation in shares, and almost without excep? tion were lower. The lars-em 'Iodines wore in the Issues of the Southwestern system. St. Louis and Iron Mountain 5s fell 3 1-2 per cent to xi 1-2, snd Missouri, Kansas and Texas con? sol 7s suffered the same loss at 96, while general 6s declined 1 1-2 to til, and general fis were onlv ll ss weak at 55. Missouri Paelf-c consols yield? ed 3-4 per cent at ll. 1-4. The other dealings Wi r<- not significant. Erie seoond consols were steady, closing only 1-4 lower at 05 3-4. and as n rule the final deo'inrs were only fractional. (if unlisted securities dealt in at the Stock Exchange.
