It wlll be reruenv bered that on Safur.l.y Mr. Wflfld attempted to raise an OWM of fact as to these, but Mr Choate in his reply atgued that there could be no such isgtie, but it was wholly a question of law, inasmuch as the moving papers contained eertifWl copies of all the returns in ques? tion, and they were before tlie ?ourt for its consideration. On that occasion, also, Kohert E. Wilkinsaiti, counsel for the Hepublicans, made a detaiied explanation of the transpa~ition of votes in one of the Eishkill districts, which is the most important of the cases outside of the marked ballots, -jnd thereuimn Judge Barnard granted the order. Notwithstanding this, Mr. Wood asked to have the matter reopened, as stated, basing his elaim on the same ground exactly that had b___i presented before. Judge Cady, with Mr. Wilkinson, appeared for the Republican side, and Mr. Wilkinson objected to the uiodilicatiou asked for on three points.
