OBDER TO REDUCE EATE first Use of Commission's New Potccr Against Express Company. •Wa*h:TiStnn. May E.— Tho Interstate Commerce Commission has rendered its first opinion In a case Involving the reaeonablenees of an express rate. The caso was broupht by the Society of American Florists, who all<>>jo<l that the rate charged "5y the fnlted States Kxpress Company on cut flowers I from Kern Jersey i.Mnts to New York City was unreasonable, excessive and unjust. Commissioner Franklin Lane, who delivers the opinion *>f the commission, holds that the rate rhould be reduced to 60 cents a hundred pounds. The express company defended Its Increase of 100 per cent in its rate by arjrulng: that tlio delivery eervlee for cut flowers in Kew York was much mere expensive than for other articles, and that it could not IncreasM Its rate a sufficient amount to met t the expense of this special service without largely increasing the total rate, because of its contracts under which It Is required to pay 4q per cent of Its pross receipts to the ralload companies. From the opinion of Commissioner Lane It ap pears "that the United Btates Express Company fcfis contracts with the Delaware, Lackawanna & Western Railroad Company by which the railroad comrany receives 43 per cent of the total gross receipts of the express company; that the service rendered by the railroad company Is no greater or tfswent under the new rate of $1 than It was under the old rate of 60 cents; that the railroad company now receives 45 per cent of the $1 rate, namely 45 cents per hundred pounds; that prior to May 1 1906. the railroad company received only one-half of •aid amount for the same service; that the per centage of gross revenue paid by the express com yar.y to the Central Railroad Company of Xew Jersey is 43 per cent and to the Lehlgh Valley Rail road Company 40 per cent; that the United States Express Company employs agents at the points of origin here concerned, who are, generally epeaking paid for their services in (fathering, billing, loading,' . unloading and delivering express matter with a percentage of the gross receipts at such offices, -which percentages range downward from 20 rer cent." An express company cannot justify a rate which in comparison with other rates, is excessive and ur.rwiFonable. by showing that it gives a service that is exceptionally expensive, where the burden of the rate charged therefor, falling upon the eh'p per reasea an already sufficient return to the railroad. An express company is entliled to charge v reasonable amount for the service which it gives and this service, being partly rendered by its own agents and employf-s and partly rt-ndered by a rail road. it cannot Justify a rate by the production of Ke own contracts nnde with the agent and the railroad. To pay the agent a rnniiiilaaliiii instead of a sal ary, and to pay the railroad a percentage Instead or a fixed amount, or a mileage, , r a tonnage, may be. ijractically, a very satisfactorj' arrangement between the express company and the rallrcad and the agent, but from the standpoint of the public fuch an arrangement cannot be held to support tne rpasoniiMeness of any rate which the express npany may choose to charge. They are not in the nature of fixed charges, because tliey are not nx«-d. Latest advices from Batopllas report encourag ing proerects in new development work. San Mi guel mine Is showing eeveral promising places. The San Antonio vein, tunnel level front. Is now over three hundred feet south of tunnel, and the vein looks beautiful. Good om Is being taken out just below the 165-foot level. A now working to tho couth shows a tine, big vein. The Canclo vein, on the 400-foot level, is in excellent shape and im proving as the workings Increase. This vein has yielded already most of the year's silver. The foot wall threadß are also very rich and promising. Big returns are looked forward to on a new work- Ing on them, connecting with, the Santo Domingo property, on the Mesqulte and Veta Grande veins, indications are that the bulk of tho silver must have shifted over on the Mesqulte vein, below tun nel level, to the north. Thl9 connection is expected to be cut Through In about four weeks, and gr^at expectations for a rich find are entertained by tha mine management. % There has been excellent buying of the stock of the Trl-Bulllon Smelting and Development Com pany In the last week of an investment character. The stock developed marked strength and activ ity after the announcement that further develop ment work had demonstrated that tho estimates and predictions of Samuel "\V. Traylor. the com pany s consulting and directing engineer, concern- Ing the richness and extent of the ore bodies in the Kelly mine are more than fulfilled and realized In the progress of the work. With the now power plant completed and In commission, the concen trating plant ncarlng completion, the prelim inary engineering work completed and ord< rs placed for the materials and machinery for the zinc oxide plant, the time when the plant will be In fullest operation has been materially advanced over original estimates. The manager of the Buffalo mine, at Cobalt, has telegraphed President Denison as follows: "Dis covered new vein showing six Inches; very rich." This is th« third new vein encountered upon this Buffalo property within the last three weeks, all showing the characteristic high grade cobalt ore. The Buffalo company Is taking advantage of tha spring weather to do com« exploration work, which liav already resulted in three rich strikes. The stock of tho Philadelphia-Cobalt was dealt in on the curb for the first time lost week. The stock sold at l\i. The Philadelphia-Cobalt Mining Com pany 1b organized under the laws of Maine, and has a capital stock of J2.000/>OO. The par value of the shares Is Jl each. Besides Its t'obalt prop erties, the Phllcdelphla-Cohalt company owns eight hundred acres in the larder Lake country, which Is in the new mining fields of Canada. B. C. Reader, who has Just been appointed super intendent of the McKlnl^y-Darragh mines at Co balt. Is a graduate of the Boston Institute of Tech nology and the Michigan School of Mines. H« has been a manager of mines for the last seven years. lie was born at Caiumet, in Michigan, and is said to be one of the most expert and thoroughly educated superintendents In Cobalt. IRON AND STEEL EXPORTS INCREASE. Principal Gain Wa3 in Rails — Port of New York Makes Record. All monthly records were agnln smashed last month In tho exports of various Iron and st>el material, when no less than C 0.206 tons were shipped through New York. The April exports further show that Kew York handled more material than ever be fore in a single month, this port having shipped nearly five times as much as Baltimore and Phila delphia combined. The' principal gain waa In steel rails, 39.20 tons of which went abroad. Of nails 2.2C2 tons were shipped, and 2,735 tons of Pipe. . < . IN THE PETROLEUM FIELDS. The search for n*-w«high grade petroleum pro ducing territory goes on uninterruptedly In the lower Southwest field, but with less than moderate euccess. Never has the demand for this class of territory been great as It is at present, and operators are paying unusual bonuses and are evf-n offering royalties of one-half the output for promising locations, but in spite of all efforts noth ing sensational has come to the front this week. Operator* are still drilling In old territory, hut in spots passed over in other days as being of llttlo or no account. These neglectod areas are now and then proving of great value. The Bpecial feature of the week was the con tinued output of the new well on the Samuel His sam farm, which was drilled In the Big Ingun last week. The farm is on Dry Run. Elsworth district, Tyler County. The well started off at over 700 bar r?-ls a day. By the last accounts It was etill pro ducing at the rate of COO barrels dally. It comes nearest to being a gusher of any well that has been struck In the lower Southwest in the last year It in close to tho No. 6 well on th- same farm' which is also large as to output and proving a jto'od stayer. This farm and the one adjoining have furnished by far the greatest number and the largest producers In all this section. A good deal of new work 1h now under way. The Congo dletrlct In still very favorably consid ered and continues to bring forth good producers. The' No 7 on the Bn-nneman farm, haa bean drilled through the Berea grit, and shows up for 1W 1 barrels a day.
