Th« Chemical National Bank has surrendered Ma ruWic deposit to the United States Treasury and the American Exchange National Bank has sur rendered part of its deposit. These two Institu tions are the only national banks in this city which do not pay interest on deposits, and in re turnlnp the funds to the government they are act ins; in pursuance of the policy long followed by them. Thomas, a former summer resi dent of Newport, the Jury in the Superior Court brought in i verdict for the defendant to-day, as he hus no property in Newport on which the. bank could mnJv«> claim. The bank sued to recover on a promissory note for 550.000. which had been given by Mr. Thomas for a loan that he had negotiated for with Charles '.v Morse, vic€-president of the bank at that time. Th* note was defaulted a.nd the summer home of the Thomases in Newport was attached. It was shown at the trial that Mr. Thomas bad transferred his Newport property to Mrs. Thomas some time prerio-js to the date of the attachment. The deed, however, was not recorded until afterward. Philadelphia, June 16.— A legal contest to determine the constitutionality of the commodity clause of the Hepburn act passed by Congress was begun in the United States Circuit Court here to-day, when arguments were made, in the proceedings Instituted by th«» government to restrain seven coal carrying railroads from transporting: anthracite coal from mines In Pennsylvania in which they are. interested to points outsida the state. The government was represented In the proceedings by Attorney General Bonaparte and two special assistants. A. Allison ■Wilmo.r and T. C. Spelling. The Interests of the railroads were looked after by a host of prominent lawyers, headed by John G. Johnson, of Philadel phia, and Robert W. De Forest, of New York. Judges Dallas. Gray and Bufflngton were on the bench. The defendant companies are the Pennsylvania, Readinp. I^ehigh Valley. Delaware. I^arkawanna & Western. Central Railroad of New Jersey. Krie and Delaware & Hudson. Mr. Johnson opened the proceedings by stating to the court that all the cases, with the exception or that of the Philadelphia & Reading, would be ar gued to-day. He understood, he said, that owing to a difference in the aspect of the case of the Reading the government was not ready to-day to proceed with that case. After the court had assented to the arrangement Mr. Wilmer opened the argument on behalf of the government. He said the introduction of the clause into the Hepburn bill was due to discrimination against a coal company by a railroad In West Vir ginia in not permitting the construction of a switch to facilitate the transportation of the coal com pany's product. Mr. Wilmer declared that the prime object of the present proceedings was to ob tain a judicial construction of the clause. He said the two companies that are the direct owners of mines are the Delaware & Hudson and the Del aware. Lackawanna & Western. The latter com pany admitted the government's allegations, he said. Mr. Wilmer then proceeded to show that, although the Delaware & Hudson company admitted it was ci gaged in the mining of coal, it denied that It was within the meaning of the act, as its organization made it a mining company and not a railroad com pany. Mr. V.ilmc-r then took up each of the bills of complaint and explained in detail each allegation against the defendants. Mr. Wilmor was followed by Mr. Spelling, who saiii that the contention of th« Delaware. Lacka wnr.nn & Western Company, that it transported coal primarily for its own use, and sold only tnich as it mii not use, was not an adequate defence, in that it did not state how much it used and how much it sold. ."The time has now come." he said, "when the government must do something to abate this great evil. The people of the country are clamoring for relief from the coal trust, and their pleadings can no longer be ignored." Mr. De Forest opened for the defendants. He limited his address to the facts of the case and the practical effects of the law if constitutional. Ho said that he was surprised at the attitude of the government counsel. Mr. Spelling, who tried "to wave the red flag alongside the Stars and Stripes." Continuing, he said Mr. Spelling i,n his address had declared that "the government had the power to stop every railway car in its tracks." Mr. De Forest remarked that the railroads did not believe this possible under the safeguards of the Constitu tion. Mr. De Forest will close his argument to-morrow. ASSAULTED BY ROBBER. Woman Struck Down in Broad Day in Farmhouse in Orange County. [By Telegraph to The Tribune.] Middletown. N. V.. June 16.— At 16 o'clock this morning, while a number of persons were within call, a robber entered the home of Mrs. Joseph McVoy, the wife of a well-to-do farmer, of near Montgomery. Orange County, struck her down and left her for dead In the cellar, and then ransacked the house. Mr. McVoy left the house at 9 o'clock to go to Walden. Hiram Dubois, eighty-five years old, father of Mrs.. McVoy. left the houFft a little later to call upon a* neighbor. When Mr. Dubois returned In an hour he found Mrs. McVoy lying in a pool of blood in the cellar. Her head had been battered In and one ear was nearly torn off. To-night Mrs. MeVoy recovered consciousness Just long enough to say that "Au gust" struck her. He was charged with taking a bet of IS, placed, according to Detective O'Connell, upon Stamina, running in the fourth race at Oravesend yesterday afternoon. The detectives say they marie inquiries in the barroom of the Hotel Metropole. and declare that Ryan was pointed out to them as a man who would take their money. The officers spy they accosted Ryan and that the prisoner took a marked (5 bill from O'Connell and entered the bet made on Stam ina in a notebook. Ryan was admitted to joO-l bail for his appearance in the Jefferson Market court to-day. Timothy Shine, proprietor of Shine's Hotel, at 36th street and Sixth avenue, went on his bond.
