14 JEROME MAKES REPLY tEXPLAIXS DICE ROLLIXG. IS aus He Committed No Crime Play l ing frith Ryan Boy j Thro^rinp dice in Pontin's restaurant -with the '"Ryan boys"— sons of Thomas F. Ryan— for drinks ifcnd a dollar to boot -was no crime, considering the ♦ circumstances, said District Attorney Jerome >•*>»- Kerday in Ills reply to the three additional charges ! made* against Mm by the King committee. In fact. JMr. Jerome raid when he rolled the cubes the con ditions were such that "apparently Pontin's was as •ITrivat* as one's own club." and there was nothing •to offend or impair the peace and order of the com munity." Mr. Jerome sets forth that on the day Vhen he shook the dice he was exceedingly wearied, ••nd hence went to Pcntin's to "eat and drink"; 'that there he saw the Ryan boys and Joined them, :nnd "some one suggested appealing to the God of 1 Chance to decide who should pay for the refresh ments of which we partook." All of this Is set forth in the forty typewritten paces which constitute the District Attorney's reply to the last charges. The reply was sent by special i messenger to Governor Hughes yesterday. The ftwo other additional charges are based on Mr. i Jerome's dining with B. R- Thomas at the City fdub when the latter was under Indictment, and Arising him as to the «election of his counsel, and ihis conduct in relation to Nathan Vidavcr and the ! marked money episode. At the end of hl« reply Mr. Jerome asks the j Governor either to dismiss the additional charges -upon the charges themselves or my answer (thereto" or to grant him a hearing on them. It Ueemed to be the general opinion yesterday that the 'Governor would adopt the latter course. In which l,ase. in all probability. Commissioner Hand will not report his findings before the middle of July. t3f the Governor should decide to dismiss the addi tonal charges. it is considered probable that Com- I mißsioner Hand will report his findings to the Gov ernor ithin ten days. ! The dice throwing vas discussed at length by ;->lr. Jerome, and there were many yesterday j «■:•" F-i:J they discerned a trace of satire in the ! District Attorney's wording of his reply. Speaking 'of the Thaw trial. Mr. Jerome said he "was ex !'tremely weary with the work and strain of a long ' and difficult trial, and from his onices wont to a I restaurant commonly known as I'ontins for some : thing to eat and drink. While there respondent's ' assistant and the Messrs. Ryan came in and pat ! down with him. The said Tontln'6 Is a place long , «>stabUshed and of the highest respectability. At i th» hour that respondent was there there are very I seldom more than one or two persons there, and i the place was not a public saloon or barroom as i these terms are generally understood." The '-.strict Attorney Insisted that he did not ■\ iolate the law in throwing dice under the clrcum ' Fiance?. On this point lie referred to various Btat 'vno?. Hi argued that If the law was reasonably 'construed no such charge could be entertained. '"because.** he said, "it Is well known that such per- Fons (Judges, lawyers and citizens of high «-har ■ arfr. great Intelligence! and distinguished position I : engage in Raws of card* such as bridge whist and i others for stakes, and such people are of such high character that they cannot b« presumed to be 'know-inely committing a felony." hi rpply to the charge In regard t* the Thomas dinner Incident. Mr. Jer<.m« said that the statement of farts in the churce itself was not fair, and th« conclusions drawn a* to his motives were not justi fied i v the facts. He said he believed that Charles W. sfctwe had been guilty of grave crimes and that ■K. R- Thomas was merely liis tool, and consequently Ibe was anxious to get Thomas to testify against Morse. He said that he had explained this to the jrrand jury. In advising him to change his counsel Mr. Jerome said he had no intention of giving Mr. Thomas "any advantage or favor except such as might accrue to him through being wisely and un nHfif>hly advised." Regarding th»» third additional charge. Mr Jerome denied that he h«.d placed himself under any obligation to William R. Montgomery, the in <3ict«l banker, and said that the latter distinctly understood that no Immunity or favor was promised to him. H^ said he believed that Mr. Montgomery's efforts to get Mr. Vidaver Into trouble were prompt r<J by "the spirit of rtvenge." which he endeavored t ., take advantage of to prosecute "public officers guilty, as respondent believes, of crimes." In doing 11, is Mr. Jerome said he was simply doing his "whole duty .in a proper manner." lEj- Telearra-">h to Th« Tril.une . ; Albany. June 16. — Mr. Jerome's reply to the three additional chuxces. which -was received at the execu tive chamber here to-day. ivM be forwarded at once to Commissioner Hand at his home in Elizabeth tntm.
