These notes, which are part of an ls?u» at $«,SOMM In payment of the Ann Arbor Railroad, ■were put iip by Rudolph Kleybolte & Co.. who headed a syndicate which underwrote the notes. weH the United States Mortgage and Trust Com pany as collateral for a loan of SKW.OfO. nibl loan was turned over by the trust company to H. B. Hollins & Co. several months apn. and to «Ha i legal title to the collateral the latter firm advertised It for Bale Bl auction last Wrdnesday. The noteholders' committee, however, obtained a tsavoMX injunction presenting the sale, on the jrrouTid that the trust company had bs,i<ihl to turn the .... notes over to the committee. It was the hearine on this temporary injunction that came up yesterday. These notes are secured ly a majority of the stock of the Ann Arbor and bence carry control of the road, which the note holders want to separate — ■ the Detroit, Toledo *: Ironton. which is in th» hands of a receiver. 3!oliins & Co.. who have a large interest in the latter property, are oppoaed to this action. The notes in question will, it Is said. Rive a majority to the sirle which succeeds in obtaining them. Prices Advance on Light Day's Trading — Rates Easy. Stock market values were weak in the. early dealings, but subsequently became strong under the influence of covering operations and moder ate support from some of the larger houses, the transactions of the latter, however, not being heavy enough to indicate a disposition on the part of the substantial Interests to assume an active stand on the bull side of speculation, as far as extensive manipulation for higher quota tions was concerned. Though these interests are committed to the bull account, holding ex tensive blocks of stocks for future profits on the long side of the market, they evidently are not yet ready to begin aggressive operations for a rise. They realize that the time is not ripe for such a movement, but they are confident prices eventually will go to a level well above that now current. Activity was confined to a few shares, notably the Harriman group. Amal gamated Copper, American Smelting. Reading and United States Steel common, the advance In the issues, however, failing to attract any public following, despite the rumor that the "millionaire pool" was operating for a material movement in Union and Southern Pacific. Some importance was attached to the dealings in Southern Pacific because of buying by a house that has been identified with the private invest ment business of the Standard. Oil leaders. Floor traders, in many instances, sold rather freely in the last hour without affect'ng prices, and the general character of the market «=\:g gested a further rally on the theory of rein vestment buying following the July disburse ments. Investors will find good opportunities for the investment of surplus funds in the bond market. Among the low priced shares moder ate purchases of Chesapeake & Ohio and New York. Ontario. & Western were N reported, the buying of the latter apparently coming from interests who for several weeks have been ab sorbing the stock. This issue is a 2 per cent dividend paying security, yielding about 5 per cent on the investment, and. compared with Chesapeake & Ohio and many other shares, it is selling at a price that is too cheap and which does not measure its merits. Chesapeake & Ohio, in which a bull pool recently operated, is selling at about the same level as Ontario & Western, while it pays 1 per cent less In divi dends. There are many instances of this sort in the present market which at some time will encourage a process of readjustment. Money rates were easy here and slightly firmer abroad. Berlin discounts were fractionally higher, and a small amount of gold was engaged at this point for shipment to Berlin to-day. Railroad earnings in th« first half of the cur rent year have made extremely poor exhibits as compared with the record breaking figures of the corresponding period in l!>07, but it gen erally is believed in railroad circles that results In the second half will show improvement, though, of course, it is not thought likely traffic receipts will anywhere near approach the re turns of the same time a year ago. Many rail roads have reduced their dividends from the level that great prosperity warranted last year and further adjustments to a lower basis will be made, but fortunately the decline in the volume of traffic has not been extensive enough to cut off dividends entirely, except in a few cases where conditions have been unusually ad verse, as. for instance, Missouri Pacific, which has suffered from the effects of business de pression and faultß on the part of the manage ment of the property. Though there has been a tremendous falling off in. the earnings of the Pennsylvania in the last six months, the com pany has earned in that time a little above the semi-annual .5 per cent rate, and as this com pany's business covers a territory in,, which about every lino of trade it- represented, its ability to earn at the rate of «1 per cent on its large amount of outstanding stock is an en couraging indication that, despite the general reaction in the country's industries, business has by no means reached the stage that fore shadows widespread bankruptcy. People who take the trouble to read the signs of the times lind many reasons for the belief that the worst period in the current wave of depression -Is a thing of the past, and those who are willinc to place their faith in the probability of big crops and the election of Mr. Taft will find ample ar gument for optimism over th<- future. There is iioiu- of that dangerous uneasiness in financial quarters that tends to induce liquidation of securities, and operatora who are working on the theory that current business conditions, which ar<- due to factors of other days, ulti mately will drive holders of securities into liquidation will make a big mistake if they back their opinion with their money.
