Washington, June 29.-Prellminary stops looking to the adjudl mof the Virginia- West Virginia debt Butt, now pending In the Supreme Court of the United Stat.? were taken at a conference here to-day between ex-Representative Charles E. Littlefield. of Maine, and counsel for the two states. It was decided that the first formal hearing in the case shaii be held at Richmond. Va., on November 9. before Mr. L-ittlefleld. the master in the proceed ings. That date was selected in order to permit conferences between counsel representing Virginia and West Virginia, with a view. If possible, to reaching an agreement on many minor points in volved in the case. Those present at the conference In addition to Mr. Littlef.eld were Attorney General William A. Anderson, of West Virginia, and Holmes Conrad and Randolph Harrison, representing Virginia; Attorney General William G. Conley, of West Vir ginia; Professor Hogg. John G. Carlisle and Mr. Mulholland. representing West Virginia, and Mr. Robinson, of New York, representing the bond holders. The dispute arose over the creation of the State of Wt-st Virginia out of the original domain of Virginia and the proper apportionment ot the bonded debt of the latter state. Just what amount la involved cannot be estimated. The original one third which the Virginia contestants set apart as the portion of West Virginia was between $30. t«»,000 an4 SJO.OUO.WO. Seavey. who had been a member of the crew of the Nellie Johnson, is alleged to have seized the nihl with two companions, William i^ oulst. wanted in Chicago for alleged counter felting, and Hugh- Colton. both of whom have disappeared and are being sought by the au thorities. , , The specific crime with which Seavey will b, charged is that of running away with a vessel upon which ho is a seaman, which comes under the l^ad of piracy and which means that he may be fined, if found guilty, not more than $10,000 or imprisoned at hard labor not more than ten years, or both. His companions can be similarly dealt with. ATEST MOVE. UEAHST'S I, Shearn Tries to Prove Ballot Boxes Were Stuffed. Efforts to prove that ballot boxes were stuffed to steal the municipal election of 1905 from William Randolph Hearst were put forth yesterday by Clar ence J. Shearn when the recount case was resumed Lefore Justice Lambert. The Hearst lawyers de clared that more ballots had been accounted for on the tally sheets of 150 ballot boxes than there were names on the pollbooks. This contention was laughed to scorn by Eu gene Lamb Richards and ex-Justice Hasbrouck, lawyers for Mayor McClellan, but neither side had made any particular tabulation of the results of the recount as compared with the pollbooks, so when Mr. Shearn asked for an adjournment until to-day on the ground of illness, promising to have data ready at that time, no objection was made by the McClellan men. The jury reassembled before Justice Lambert yesterday to pass cm the forty-three boxes from. Richmond, the envelopes of which are missing, and to decide on the admission of three boxes in ques tion from Manhattan. Mr. Shearn immediately be gan to try to prove ballot box stuffing. He had subpoenaed lit) of the poll books from the office of the State Superintendent of Elections. Krnest Edwin Murray, of the New York Audit Company, swore that he had totalled the number of names appearing on the pollbooks of the Bth Election District of the 6th Assembly District, finding that there were 230 names with addresses and ballot numbers against them, and seventy-nine with no ballot numbers against them. It appeared, he said, that S&9 votes had been cast, according to the pollbooks. Mr. Shearn declared that the re count showed there were 393 ballots In the box and envelope, an excess of thirty-four. Under examination by Mr. Richards, Murray ad mitted that he had not examined the book of regis try, the pollbooks in the County Clerk's office nor the ballot clerk's returns. Mr. Richards insisted that no such excess of ballots was shown, accord ing to the jjollbooks in the County Clerk's office. There were supposed to be three sets of pollbooks— one deposited with the bureau of elections, one with the County CTerk and one with the State Superintendent of Ejections. Naturally, the figures In all should be identical. T!i>- election law provides that If there should be found in boxes and envelopes a number of votes in excess of that indicated by the pollbooks all the ballots should be replaced in the box, the number in excess drawn out by lot and the re maining ballots counted and the result declared official.
