Sept 23.— The Egrg-O-See Cereal Com pany, with headquarters in Chicago and factories In Buffalo and Quincy. 111., has been placed In the hands of a committee of creditors. The assets are valued by the company at $1,500,000. but the creditors are nald to regard them as about equal to the indebtedness. An auditing committee now at -work on the company's books Is expected to make a detailed report by Saturday. Chicago. Sept. tt, Wfcßa auditors employed by the creditors' committee to-day began an ex amination of the hooka and accounts of the Bat tle Creek Breakfast Food Company, the cor porate name of what is commonly called the Egg- O-See Cereal Company, officers of the company declared that there was nM nw nor had there ever been a question of the company's solvency. An authorized etatement from the creditors' committee containing; less than fifty words was given to those questioning the officials. It reads: The Battle Creek Brenkfast Food Company has ext sndins; Its business faster than was war ranted by its working capital, and is now confer ring wit -1 a committee representing its principal creditors for the purpose of investigating its general condition and determining Its future Supplementing the statement. L. D. Wallace, assistant general manager at the Chicago offices of the company, said : "There is absolutely no question of the sol vency of the company; the problem Is simply one of policy. The assets of the company exceed Jl.Csn.noo, and the liabilities do not exceed *435.000. P. R. R. AND TIME LIMIT ACT. ■With reference to the newspaper dispatches from ! Washington, published on September IS, stating that the Pennsylvania. Railroad Company and other railroads named "will do everything possible to escape compliance with the act of Congress limit ing to sixteen hours the continuous service of em ployes," the following: statement is authorized: The company has not done, or attempted to do, ' anything to escape compliance with the require ments of the act at Congress. On the contrary, it" is now (aa it has been at all times since the act became operative) strenuously endeavoring- in good faith strictly to comply with its requirements. This Is too well known and clearly understood by all employes in its system to admit of controversy. The equity suit in tl»e federal court for the East ern District of Pennsylvania instituted by the company against the Interstate Commerce Commis sion — which has not yet been heard — neither at tacks the validity of the act nor seeks to avoid observance of and obedience to its mandates, as' erroneously stated in the dispatches. It simply seeks relief against an order of the commission requiring voluminous monthly reports, which is confidently believed to be unlawful, and in the • orderly and well established course of legal pro cedure submits the question respecting the valid ity of the order for consideration and determina tion by the court. Any statement either regarding • the company's atttitude in respect to the act of Congress or the purpose and scope of the pending suit inconsistent with the foregoing is wholly una ware-anted and without foundation in fact. Toronto, Sept. 23. — At to-day's meeting of the American Association of General Passenger ar.d Ticket Agents, G. T. Bell, the new president, took over the reins of office, S. G. Hatch, of the Illinois Central, was chosen vice-president, and C. L. Burt, of the Boston & Maine, was re-elected secretary. The next convention will be held at Toledo. Samuel Moody, general passenger agent of the Pennsylvania lines west of Plttsburg. read a paper at yesterday's session against offering re duced fares for delegates to meetings of societies an.l associations. Recent legislation, he said, had greatly reduced the fares and enormously in creased the cost of carrying. The general im pression was that the 2-cent fare had come to stay, and they should begin to educate the public to the fact that no fare should be less than two cents a mile. He said: Tire annual report of the Pennsylvania i-om pany shows that the average expense a passenger a mile in 1900 was 2.05 cents,; in 190?, it was 2.07. while in IW7 it had gone up to 2.17. On the other hand, the average earnings a passenger a mil<» were 2.03 cents in 1900. 2.16 in 1903. and in 19°7 — due to national and state laws and other conditions — they were onlj- 1.87. We therefore lost for each passenger a miie in 1907 three tenths of a cent. He also advised that the usual reduced fares for holidays should be discontinued. BASEBALL SCORES ON FAST TRAIN. EMBEZZLER'S SENTENCE COMMUTED. Washington, Sept. 2".— The President has com muted the five-year sentence in the Baltimore city jail imposed upon William H. White, the book keeper and paying teller of the Canton National Bank, of Canton. Md.. to three years and four months, with allowance for good conduct. White was convicted in January, 1907. of embezzling sev eral thousand dollars from the bank. He, how ever, appeared as a witness against another person implicated, and the Attorney General held that the second person's conviction could not have been secured without White's testimony. P. O, EMBEZZLER GIVES HIMSELF UP. Cleveland, Sept. 23.— John D. Chapman, formerly assistant postmaster at Akron, who enfbezzled over $9,000 from the Akron postoffl.ee. and who disap peared on March 10 last, pleaded guilty in the Knited States District Court here to-day. Chapman said he had been in Goldfleld, Nev., since he left home. He returned to Akron last night and sur rendered himself to-day. He is thought to have lost the money in stock speculation.
