Li-Vice-Chancellor talker to-day granted a preliminary in junction against the Hudson County Water Tffompany restraining it from laying pipes under the Kill Van Kull for the purpose of supplying Staten Island with water taken rom driven wells near Belleville. The com pany claimed a right to lay the pipes under a riparian grant made by the state to the Guffey Petroleum Company and a license obtained from the Secretary of War. Vice-chancellor Walker, however, held that the state is the owner of the lands be tween high-water mark and the boundary line between New York and New Jersey, and that the provisions of the river and harbor act. empowering the Secretary of War to grant a license for the placing of structures for making excavations under the tide waters of th« United States, Is a mere regulation for the benefit of commerce £hd navigation- j The Injunction will have the effect of preventing the Hudson County Water, Com pany from carrying out its contract to sup ply Staten Island with water.
