Kryan L. Kennelly held another success
ful sale at the Vesey Street Salesrooms
! Bntavanjr. He sold for the ebtate of Thomas
Patten eight parcels for J290.290, which was
About $32,000 more than the estate antici
pated. The rooms were crowded.
The bidding was very spirited, especially
for the No. 44 West 28th street parcel. The
bidding for that started at $60,000, and was
carried by a number of bidders up to $34,250.

QUEENS ACREAGE DEAL.
Burton Thompson has sold fifty-two acres
in the Trains Meadow section of the Ud
Ward of Queens for Dr. Oliver Livingstone
Jones. The sale was made to clients of A.
C. Orndorff.
The property sold has a large frontage
on Flushing avenue. It is bounded on the
east by the Old Bowery Road, over which
passe? the only line of the Brooklyn Rapid
Transit that enters this section. The line
runs to North Beach.
It is understood that th© property was
held for $6,000 an acre. It is a part of a
tract of 192 acres, the remainder of which
runs out to and faces on Flushing Bay.
Dr. Jones has owned the property for about
fifteen years.
NEW MOUNT VERNON VALUES.
Steven B. Ayres and Frank S. Beavis
have sold to Lillian Nugent a tot on South
Fulton avenue, opposite the proposed site
of the new station of the Xew York. West
ohester & Boston Railway Company. Two
years ago the lot was sold for $600; a year
ago it was offered for $1,200, and no cus
tomers could be. found. It has now been
sold for more than $2,0Q0, and the new pur
chaser has already been offered a profit.

G. G. Benjamin to Time Store
in New Structure.
George G. Benjamin has leased one-half
the ground floor of the new Fifth Avenue
Building, at Fifth avenue and 24th street,
for a period of twenty-one years. The new
quarters will be occupied as soon as the
Benjamin store at Broadway and 26th
street can be vacated. It is understood that
the transaction involved $1,000,000.
The new location includes the site occu
pied by Maillard before the Fifth Avenue
Hotel was demolished. It has 5,800 square
f^et floor space on the street !evel¥and
7,000 square feet in the basement, and is
divided from the rest of the building by the
rotunda and the arcade running from 23d
street to 24th street.
Mr. Benjamin said yesterday that lie re
garded the new site as an ideal one for a
men's store.

Justice Carrick, in the Ist District Court
of Jersey City, has handed down an im
portant decision respecting the buying or
selling Of real estate in New Jersey.
Last summer Mr. and Mrs. Everett tun
ken, of Nil 2*» Union street, requested
Edward baterman, st Jackson avenue real
nstate dealer, to timJ a purchaser for thetr
house. Laterman found a man who <>x-*
pressed a desire to purchase the property
The prospective purchaser paid a deposit
oi $•■•.'>) to bind the bargain.
Laterman. according to the testimony,
telephoned to Mr. Millken, asking if tbla
was satisfactory. lUliken. be tcstitt.d, re
plied that it was.

the lime came to close the deal the pros
pective purchaser backed out. The Mill
kens then brought suit against Laterrnan

commission. Justice Carrick took this view
of the transaction and decided accordingly.
